SUBJECT:

A Resolution to Award the Waubonsie Lake Restoration Improvements Contract to Lakes and Rivers Contracting, Inc. in the amount of $1,845,000.00.

 

PURPOSE:

To award the construction contract for the Waubonsie Lake Restoration Improvements, located at Waubonsie Lake Park at the intersection of Kautz Road and Montgomery Road in Ward 8.

 

BACKGROUND:

In 1991 the City executed an Intergovernmental Agreement (IGA) with the Fox Valley Park District pertaining to the cooperative use of storm water detention/retention systems (R91-88, attached as Exhibit "A").  This IGA outlines the maintenance responsibilities of each party for various storm water detention/retention systems, one such system is Waubonsie Lake.  Based on a study completed in 2012, the lake has met the necessary criteria for sediment removal via dredging.

 

DISCUSSION:

Bids were opened and read aloud on June 30, 2016.  The tabulation of the 5 bids received is attached as Exhibit "B".  In addition to the base bid, bidders were encouraged to provide an alternate bid utilizing construction methods other than those shown in the base bid.  Three alternates were provided, as summarized below:

 

Fox Excavating (lowest alternate provided): modify the dam downstream of the lake to dewater the lake faster than through the use of pumps as provided for in the base bid.

 

Lakes and Rivers (second lowest alternate provided): utilize a series of barges to mechanically dredge the lake without dewatering.

 

Earthwerks (highest alternate): dewater the lake and truck the material offsite rather than depositing onsite. 

 

It is our recommendation to award to Lakes and Rivers, even though they are not the lowest alternate provided.  It is our opinion that there are significant advantages with removing the sediment without dewatering, including benefits to aquatic life, minimized impacts to users of the park facility, minimized impacts to the adjacent resident and school properties, minimized construction delays associated with seeking a dam modification permit and no additional permit fees for the dam modification permit.  Further, there will be savings in construction engineering, as engineering staff will be able to perform the inspection in-house if the lake is not dewatered; if the lake is dewatered a construction inspection contract with an outside consultant will be required due to the increased scope of work, which will exceed the capacity of the City engineering staff.  Funds are budgeted in account 280-1852-512-81-90.

 

IMPACT STATEMENT:

All excavated materials are to be kept on-site so there will be no truck traffic generated due to removal of the materials; activities at the park will be disrupted and access to the lake and trail around the lake will be impacted, which has already been communicated with the Fox Valley Park District.  Additionally, awarding to Lakes and Rivers will result in completing the project with the least amount of disturbance to the aquatic life in the lake, as it will not be dewatered, which will also result in less impact to adjacent properties.

 

RECOMMENDATIONS:

I recommend awarding the Waubonsie Lake Restoration Improvements Contract to Lakes and Rivers Contracting, Inc., 15480 Canal Bank Road, Lemont, IL 60439, in the amount of $1,845,000.00.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, an existing intergovernmental agreement between the City and the Fox Valley Park District states that the City is responsible for sediment removal in the lake; and

 

WHEREAS, the project was bid publicly with a base bid and a bidder proposed alternate; two base bids and three alternates were received and read aloud at 2:00 p.m. on June 30, 2016; and

 

WHEREAS, the City has budgeted for this project in account 280-1852-512-81-90 and has elected to award the project to Lakes and Rivers Contracting, Inc. in the amount of $1,845,000.00 for the bidder proposed alternate; and

 

WHEREAS the Lakes and Rivers bid was not the lowest alternate bid received; however it was the only submittal that could be completed without dewatering the lake, and it does not require working with the IDNR for a dam modification permit; and

 

WHEREAS completing the project without dewatering the lake will be advantageous to the City, surrounding properties and aquatic life in the lake.

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: the Director of Purchasing is hereby authorized to award a contract to Lakes and Rivers Contracting, Inc. in the amount of $1,845,000.00 for the Waubonsie Lake Restoration Improvements.
