A resolution authorizing the Director of Purchasing to adopt unit prices submitted by Waste Management of Illinois for the disposal of excavated spoils that cannot be classified as Clean Construction Demolition Debris (CCDD).
PURPOSE:
The purpose for this resolution is to provide a means for the City's Water and Sewer Maintenance Division to dispose of spoils that cannot be disposed of as CCDD material.
BACKGROUND:
35 ILL. Adm. Code 1100 requires testing of soils excavated from sites with a history of activity that may have resulted in soil contamination. The code also requires that spoils excavated from residential sites be tested for pH. Soils that do not meet the requirements for disposal at a CCDD landfill must be disposed of at a facility permitted to accept such contaminated material.
The City of Aurora's Water and Sewer Maintenance Division regularly generates excavated spoils while maintaining the City's water and sewer infrastructure. Environmental Science professional services are required to classify excavated spoils for proper disposal. Depending on the results of the soils analysis, spoils are disposed of as CCDD, non-special waste or special waste.
DISCUSSION:
On May 1, 2019, the City's Purchasing Division advertised a request for proposals for the disposal of non-CCDD material. On May 15, 2019, the Purchasing Division opened proposals from two landfill operators. The proposals were evaluated based on per ton dumping costs, trucking expenses, and costs to comply with landfill specific testing requirements.
As shown on the attached evaluation spreadsheet, Waste Management of Illinois's Dekalb site is the most economical disposal facility. The per ton prices are valid for 12 months.
Local preference does not apply to this proposal.
Funding for this expense is provided in the 2019 budget in account 510-4063-511.36-13 within the Water and Sewer Fund. The 2019 budget includes $80,000, of which $43,500 is unencumbered. The 2020 proposed budget includes $105,000 for non-CCDD landfill expenses. Based on historic activity it is estimated that approximately 4500 tons of non-CCDD spoils will be generated over the next 12 months.
IMPACT STATEMENT:
This resolution is needed in order to provide a means for disposing of excavated soils that are generated on a day to day basis by the City's Water and Sewer Maintenance Division.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, on May 15, 2019 the Director of Purchasing received two proposals from landfills for the disposal of excavated spoils that cannot be classified as Clean Construction Debris; and
WHEREAS, the proposals were evaluated based on proximity, travel time, and testing requirements; and
WHEREAS, the aforementioned evaluation revealed that the proposal submitted by Waste Management of Illinois for a per ton dump fee of $21.00 is the most economical option for the City of Aurora; and
WHEREAS, said per ton fee is valid for 12 months, and
WHEREAS, the 2019 and proposed 2020 budget includes funding for this expense in the Water and Sewer Fund within account number 510-4063-511.36-13; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: The Director of Purchasing is hereby authorized to adopt the per ton dump fee submitted by Waste Management of Illinois.
