A Resolution Accepting Dedication of right-of-way for Indian Trail Road and Dedication of a City Easement located at 250 E. Indian Trail, Aurora, Illinois 60505 (East Aurora School District - 14-00622 / AU10/4-13.505-M - TV - Ward 1)   
 
PURPOSE:
The Petitioner, East Aurora School District, has submitted a Plat of Dedication for Indian Trail Road and Plat of Easement for a City Easement at 250 E. Indian Trail.  East Aurora School District recently purchased this property for the District's full day Kindergarten Center and is currently renovating the building.  As part of the project, the Petitioner is dedicating10 feet of right-of way for Indian Trail Road and granting a City Easement over the new watermain.    
 
BACKGROUND:
The Subject Property is located at 250 E. Indian Trail and is currently a vacant building with B-2(S) zoning.  This building was originally built as a Frank's Nursery and then was converted to a church by Family and Faith Christian Church.  
 
DISCUSSION:
Staff has reviewed the petition, submitted by the petitioner and have sent comments back to them on those submittals.  The petitioner has made all the requested changes to these documents and they now meet all of the applicable codes and ordinances.  
 
IMPACT STATEMENT:
The Planning and Zoning Division would anticipate that this project will increase the City's overall tax base and viability which will offset any incidental Department or staffing impacts.   
 
RECOMMENDATIONS:
Staff would recommend APPROVAL of a Resolution Accepting Dedication of right-of-way for Indian Trail Road and Dedication of a City Easement located at 250 E. Indian Trail, Aurora, Illinois 60505

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
 
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
 
WHEREAS, it may be necessary in the future to construct additional public roadway and provide utilities within the proposed right-of-way dedication area; and
 
WHEREAS, upon petition of the property owners, East Aurora School District, the City of Aurora has been offered in dedication suitable vacant land for the purpose of locating thereupon the proposed public roadway and any utilities and locating utilities within an easement as described on Exhibit "A" attached hereto; and
 
WHEREAS, the City desires to receive and accept the dedication and granting of such real estate, in accordance with Section 11-105-01 of the Illinois Municipal Code (65 ILCS (1994) 5/11-105-1); and  
 
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that upon petition of the property owners, the City hereby receives and accepts the dedication of the right-of-way for public roadway and any utilities located within said public right-of-way and the granting of the easement, as described on Exhibit "A" attached hereto; provided, however, that such acceptance of dedication and granting does not relieve the developer of its obligations to construct such roadways and/or utilities in accordance with the City of Aurora Public Improvement Ordinance.
