Requesting authorization for the appropriation of Motor Fuel Tax (MFT) funds, for Design Engineering and Stormwater Fees, in accordance with the Second Amendment to the Intergovernmental Agreement between the City of Aurora, the City of Naperville, and the Naperville Township Road District, to widen North Aurora Road in the vicinity of the CN Railway Crossing
PURPOSE:
To obtain council approval for a resolution appropriating Motor Fuel Tax (MFT) funds by IDOT Resolution.
BACKGROUND:
The project is a joint multi-jurisdictional project with the City of Aurora, City of Naperville, and Naperville Township Road District, to improve the regional transportation network.
This is an ongoing project that began in 2006 with Phase 1, preliminary engineering. Phase 1 was completed and accepted by IDOT in 2016. In 2016, Council approved the First Amendment to the Intergovernmental Agreement which covered the right of way acquisition for the project. The project is currently in process of land acquisition.
The current boundary agreement between the City of Aurora and City of Naperville commits the City to the Phase 2, design engineering process, covered under the Second Amendment to the Intergovernmental Agreement, adopted by Council Resolution R17-067 on March 14, 2017. The City of Naperville is the lead on this project.
By completing the Phase 2, the project will be in a better position to apply for grant funding as it becomes available for final construction. The anticipated construction costs are anticipated to exceed $30,000,000. However, the current boundary agreement limits the City of Aurora contribution to a little over $3,000,000 of the total cost and construction, which would not move forward without mutual consent of both cities.
DISCUSSION:
The project design will include a five lane section with sidewalk on one side and a multi-use path on the other. This will require widening of the CN structure over North Aurora Road.
The resolution authorizes the use of Motor Fuel Tax funds to meet the obligations previously approved in the IGA. The City is required to contribute $400,000.00 in 2017 and an additional $310,000.00 in early 2018, for a total of $710,000.00. Funding made available in the FY 2017 approved budget:

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, the City desires to construct the widening of North Aurora Road under the CN Railway Crossing
WHEREAS, the City has partnered with the City of Naperville and Naperville Township Road District to complete such construction;
WHEREAS, the City is required to pass a resolution appropriating the use of Motor Fuel Tax prior to it's use on a project;
WHEREAS, the FY 2017 City of Aurora Budget provides funding by way of the following account:

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: the City Clerk is authorized to sign the Motor Fuel Tax Appropriation as set forth in IDOT form BLR 09110.
