SUBJECT:

The City of Aurora, through the Aurora Police Department, is requesting approval of the agreement between the Aurora Police Department and Indian Prairie Community Unit School District No. 204 (District 204) concerning the Police School Resource Officer Program at District 204.

 

PURPOSE:

This Resolution for an agreement between the Aurora Police Department and District 204 updates the school resource officer agreement.  Both the City and District 204 will benefit from the updated agreement that defines roles for each party.

 

BACKGROUND:

The Aurora Police Department requested an updated agreement between all school districts in the City of Aurora for the School Resource Officer Program.

 

DISCUSSION:

This agreement updates the previous agreement in place with District 204 on the role of the school resource officer in the school buildings and the role the District has in the review and selection of officers in their District.

 

IMPACT STATEMENT:

This agreement will continue to provide District 204 with three full time School Resource Officers.

 

RECOMMENDATIONS:

The Aurora Police Department requests that the Government Operations Committee approve this Resolution and forward it to the Committee of the Whole and then City Council.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, the School Resource Officer Program will provide enhanced communication between Indian Prairie Community Unit School District No. 204 and the Aurora Police Department; and

 

WHEREAS, the School Resource Officer Program will continue to develop respect and trust for law enforcement and responsibility among the youth enrolled at Indian Prairie Community Unit School District No. 204; and

 

WHEREAS, Article VII, Section 10 of the Illinois Constitution of 1970 authorizes intergovernmental cooperation such as is contemplated by the Agreement, and Illinois statutes provide that public agencies may share powers through intergovernmental agreements (5 ILCS 220/1 et. seq.); the City is a unit of local government (Ill. Const., Art. VII, Sec. 1) and a public agency (5 ILCS 220/1).

 

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that the Mayor is authorized to execute the Agreement between the Aurora Police Department and Indian Prairie Community Unit School District No. 204 (a copy of said Agreement is attached hereto as Exhibit A and made a part hereof) and is fully adopted as set forth in the attached document.  Additionally, the Clerk is to maintain a copy of this Agreement once signed by the Mayor.
