Ordinance Authorizing the Mayor and City Clerk to Enter into an Agreement with Metra for Operation and Maintenance of the Commuter Parking Facility in the City Of Aurora at the Route 59 Commuter Train Station.
PURPOSE:
To obtain authorization to enter into an "Agreement for Operation and Maintenance of the Commuter Parking Facility in the City of Aurora" with Metra.
BACKGROUND:
The Route 59 Commuter Train Station is located at 1090 N. Route 59, which is north of Meridian Lake Drive and West of Route 59. Metra constructed and owns the west section (attachment exhibit "B") of the underlying lands on which the Aurora's commuter parking facility is located.
The City entered into an agreement with Metra on June 25, 1996 (Ordinance No. O96-71) for the long-term operation and maintenance of the parking facility. Since 1996, the City has approved three amendments in 1997, 1999, and 2001 to the Operation and Maintenance agreement. The current agreement (20 year term) with Metra is set to expire on June 25, 2016.
DISCUSSION:
Metra and City staff have both reviewed the proposed agreement, attached as exhibit "A", Agreement for Operation and Maintenance of Commuter Parking Facility in the City of Aurora. Both parties agree that the purpose of this agreement is to ensure that the parking facility at the commuter station continues to be maintained by the City of Aurora. The term of the Operation and Maintenance Agreement is for forty (40) years from said date unless otherwise terminated by either party for any reason with ninety (90) days written notice.
IMPACT STATEMENT:
No Impact, all costs for the operation and maintenance of the parking facility are funded solely by parking fees
RECOMMENDATIONS:
That the City of Aurora approve the "Agreement for Operation and Maintenance of Commuter Parking Facility in the City of Aurora" with Metra at the Route 59 Commuter Train Station.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, Commuter Rail Division of the Regional Transportation Authority, a division of an Illinois Municipal Corporation ("Metra") constructed and owns the parking facility properties located north of and adjoining Meridian Lake Drive in Aurora, Illinois, identified by parcel number 07-16-202-008 and 07-16-202-009 and delineated on "Exhibit B” ; and
WHEREAS, the City of Aurora and Metra have entered into an agreement on June 25, 1996 (Ordinance No. 096-71) for the construction and operation of the commuter parking facility at the Aurora Route 59 Commuter Train Station; and
WHEREAS, said term of the Operation and Maintenance Agreement will expire June 25, 2016; and
WHEREAS, said Agreement has been amended on three (3) subsequent occasions on September 3, 1997, February 9, 1999 (Ordinance No. O99-08) and July 17, 2001 (Resolution No. R01-370); and
WHEREAS, the City of Aurora and Metra desire to amend the term of the agreement, attached hereto as "Exhibit A”; and
WHEREAS, said agreement would mutually benefit the City of Aurora and its Citizens and Metra; and)
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Aurora, Illinois, as follows: that the Mayor and City Clerk are hereby authorized to execute the Agreement for Operation and Maintenance of the Commuter Parking Facility in the City of Aurora with Metra, a copy of which is attached, hereto as “Exhibit A”.
