Requesting Authorization for the Mayor to Execute the Local Agency Agreement for Federal Participation with the State of Illinois, the Director of Procurement to sign the Engineering Agreement with Crawford, Murphy and Tilly, Inc., and the Appropriation of Motor Fuel Tax Funds for the Farnsworth Avenue Improvements Project, MFT #13-00302-00-BR. 

 

PURPOSE:

This Resolution will Authorize the Intergovernmental Agreement to Utilize Federal Funds, Approve the Engineering Services Agreement and Appropriate Motor Fuel Tax (MFT) funds.

 

BACKGROUND:

In 2014, the City began the Engineering to improve Farnsworth Avenue from Sheffer Road to Mountain Street.  Improvements will include the installation of new watermain, storm sewer, replacement of the triple culverts at Indian Creek with a new pre-cast deck beam bridge, raising of the street profile to alleviate flooding, roadway reconstruction and resurfacing.

 

DISCUSSION:

Design plans and specifications are complete and the project is scheduled for a March letting at the Illinois Department of Transportation (IDOT). IDOT will be the awarding agency and will front fund the construction cost estimated to be nearly $4,500,000.

 

The city has secured Federal Highway Authority Funds to cover 80% of the participating construction and engineering costs. The attached Local Agency Agreement for Federal Participation - BLR 05310 (Exhibit ‘A’) provides these Federal Funds.  The City's total cost for this project is expected to be $1,482,318 which includes the city's 20% share and $324,500 for watermain replacement (non-participating construction).

 

The City of Aurora is the lead agency responsible for overseeing construction and has retained Crawford, Murphy and Tilly, Inc. (CMT) to provide full time on-site construction inspection. The attached Engineering Agreement (Exhibit ‘B’) from CMT is in the amount of $427,600.59. The City will front fund these engineering costs with Motor Fuel Tax (MFT) funds and will be reimbursed 80% of the costs or approximately $342,080.

 

IDOT requires a Resolution to Appropriate the MFT funds prior to their expenditure for approved projects.  The Resolution for Improvement - BLR 09111 appropriating MFT funds in the amount of $1,300,000 is attached as Exhibit 'C'.

 

The 2017 Budget provides $1,300,000 for this item in account no. 203-4460-431-76-35    (Motor Fuel Tax), $400,000 in account no. 510-4063-511-73-02 (Water & Sewer Fund) and $200,000 in account no. 280-1852-512-81-23 (Storm Water Mgmt Fee).

 

IMPACT STATEMENT:

Construction is expected to begin in May, 2017 and completion is scheduled for October, 2018.  During most of the construction, traffic will be reduced to one lane in each direction and motorists will encounter delays.

 

RECOMMENDATIONS:

Please forward this resolution to the Finance Committee for their review and recommendation for approval.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, the  City of Aurora endeavors to improve a segment of Farnsworth Avenue from Sheffer Road to Mountain Street that is approximately 0.47 miles in length and to the Illinois Department of Transportation as Section Number 13-00302-00-BR and State Job Number C-91-363-14; and

 

WHEREAS, the Construction and Engineering costs of said improvement have necessitated the use of federal funds and Motor Fuel Tax funds; and

 

WHEREAS, the City of Aurora received three million, three hundred thirty three thousand and two hundred seventy two dollars ($3,333,272.00) in Surface Transportation Program Bridge (STP-Br) federal funding; and

 

WHEREAS, the use of federal funds requires a joint funding agreement with the Department of Transportation of which agreement is attached hereto and incorporated herein as Exhibit 'A'; and

 

WHEREAS, there is a need for an Engineering Agreement with Crawford, Murphy and Tilly, Inc. 550 Commons Drive, Suite 116, Aurora, IL  in an amount not to exceed $427,600.59, a copy of which agreement is attached hereto and incorporated herein as Exhibit 'B', and

 

 

 

WHEREAS, there is a need to appropriate Motor Fuel Tax funds for this project in the amount of $1,300,000.00, a copy of which resolution is attached hereto and incorporated herein as Exhibit 'C'; and 

 

WHEREAS, the 2017 City Budget provides $1,300,000 for this item in account no. 203-4460-431-76-35 (Motor Fuel Tax), $400,000 in account no. 510-4063-511-73-02 (Water & Sewer Fund) and $200,000 in account no. 280-1852-512-81-23 (Storm Water Mgmt Fee).

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that the City of Aurora authorizes One Million Nine Hundred Thousand dollars ($1,900,000.00) or as much of such sum as may be needed to match federal funds in the completion of the aforementioned project known as Section Number 13-00302-00-BR, that the Mayor is authorized to execute the Local Agency Agreement for Federal Participation with the State of Illinois (Exhibit 'A'), the Director of Procurement to sign the Engineering Services Agreement with Crawford, Murphy and Tilly, Inc. (Exhibit 'B') and the City Clerk to sign the Motor Fuel Tax Resolution (Exhibit 'C').

 

BE IT FURTHER RESOLVED that the Mayor is hereby authorized any other such documents related to advancement and completion of said project.
