Acceptance of bid recommendation for asbestos abatement at the former West High Building located at 14 S. Blackhawk Street, Aurora, IL Ward 4/Saville
 
PURPOSE:
Pursuant to Illinois Environmental Protection Act, 415 ILCS, et seq. the City of Aurora is required to conduct a comprehensive National Emission Standards for Hazardous Air Pollutants (NESHAP) survey of suspect asbestos-containing materials (ACM) for compliance with the Illinois EPA. The asbestos inspection was performed from May 23 - 30, 2014. This comprehensive NESHAP inspection was intended to address the existence of ACM on the interior and exterior prior to future demolition of the building.
 
BACKGROUND:
The City of Aurora owns the former West Aurora High School property located at 14 S. Blackhawk Street.  The structure is approximately 30,000 square feet in size and was previously utilized as a school building. The original building was constructed in 1905, with additions built in 1938 and 1950, respectively. The 1905 wing consists of three stories and a basement which houses the boiler room. The 1938 wing consists of two stories, and houses the gymnasium and lower lever locker rooms. The 1950 wing is one story and consists of the music rooms. The flooring varies throughout the wings, consisting of concrete, wood, floor tile, linoleum, terrazzo, and carpet. The interior walls and ceilings vary throughout the wings, consisting of plaster, drywall, concrete, cinderblock, and acoustical ceiling tile. The exterior walls are brick. The original building and additions have undergone a number of renovations that used Asbestos Containing Materials (ACM).  
 
The building's integrity has been compromised by both the removal of metal piping and other appurtenances for resale.  Additionally, several large holes in the roof have allowed water, snow and ice to impact the interior condition of the building.
 
Two historic murals were also in the building.  School District 129 and the City of Aurora worked to have the murals removed from the school building during the period of February to July, 2014.  On the advice of the Environmental Consultant, the School District is having the murals decontaminated under a contract directly with the District.
 
DISCUSSION:
Plans and specifications were prepared for bidding the asbestos abatement separately from the general demolition and site restoration to limit the potential markup on the overall demolition costs and to target companies specializing in asbestos abatement for the cleanup project. A total of seventy (70) homogeneous areas were identified within the scope of work. Out of the seventy (70) homogeneous areas, thirty-four (34) homogeneous areas tested positive for asbestos content and one (1) homogeneous area was assumed to contain asbestos.  A complete list of the Asbestos Containing Materials is listed in NESHAP Asbestos Survey.  The list includes pipe insulation, fire door insulation, Drywall Tape and Joint Compound, Linoleum and Tile, 9x9 Floor Tile and Mastic, Boiler Insulation, Boiler, Breeching, Transit Panel Drawer Liners, Roof Flashing, Roof Tar, Window Caulk, etc.
 
A Notice to bidders was advertised in the local newspaper on Sunday, August 31, 2014.  A mandatory pre-bid walk-thru was held on Tuesday, September 9, 2014 and a total of 12 ACM Abatement Contractors picked up plans and attended the meeting.  A total of three bids were submitted and opened on Wednesday, September 24, 2014.  Bids ranged from a low $589,400.00 to a high of $747,000.00.
 
The apparent low bidder is Valor Technologies, Incorporated, 3 Northpoint Court, Bolingbrook, IL 60440.  Their bid of $589,400.00 was made accepting all project conditions.  Valor indicated that they would use no subcontractors. Reference checks indicated no problems or issues with Valor Technologies in the completion of asbestos abatement projects of this magnitude.  The Laborers International Union Local 149 Business Manager Dan Brejc confirmed in a phone call that there are no labor agreement problems with this contractor.
 
Account number 215-1710-417.71-01 (Cost of Land) has the necessary funds which are being transferred to Account 215-1710-417.36-25 (Demolition) to complete this phase of the demolition requirements. A budget transfer has been prepared and submitted.
 
IMPACT STATEMENT:
The impact during this phase of the demolition project will be minimal to surrounding streets and traffic.  Permitting will take place, the site during remediation is required to be monitored which will be managed through Wills Burke Kelsey and performed by sub-contractor Midwest Environmental Consulting Services, Inc. The work being performed is estimated to take 6-8 weeks. The Department of Neighborhood Standards has the oversight for this project.
 
RECOMMENDATIONS:
Based upon the support of the Project Engineer Wills Burk Kelsey Associates, Ltd, I recommend that the City of Aurora contract with the low bidder Valor Technologies, Inc. of Bolingbrook, IL for Asbestos Abatement Project located at 14 S. Blackhawk St. in the amount of $589,400.00

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
 
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
 
WHEREAS, pursuant to Illinois Environmental Protection Act, 415 ILCS, et seq. the City of Aurora is required to conduct a comprehensive National Emission Standards for Hazardous Air Pollutants (NESHAP) survey of suspect asbestos-containing materials (ACM) for compliance with the Illinois EPA.
 
WHEREAS, the asbestos inspection was performed from May 23-30, 2014. This comprehensive NESHAP inspection was intended to address the existence of asbestos containing materials on the interior and exterior prior to future demolition of the building, and 34 homogeneous were found throughout the building which require proper remediation
 
WHEREAS, twelve contractors attended a mandatory pre-bid meeting and three contractors submitted bids with a range of $589,400.00 to $747,000.00 which were opened at public bid opening on September 24, 2014)
 
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: accepts the lowest qualified bid for asbestos abatement at the city owned property located at 14 S. Blackhawk Street, Aurora IL from Valor Technologies, Inc of Bolingbrook, IL in the amount of $589,400.00 and the Purchasing Director for the City of Aurora is authorized to execute all orders from account #215-1710-417-36.25
