A Resolution Approving the Final Plat of Subdivision for Washington Middle School Subdivision located at 231 S. Constitution Drive and 233 S. Constitution Drive (West Aurora School District #129/Fox Valley Park District/Aurora Public Library - 26-0041 / AU19/1-26.013 - Fsd - JR - Ward 5)
PURPOSE:
The Petitioner, West Aurora School District #129, Fox Valley Park District, Aurora Public Library, is requesting approval of a Final Plat for Washington Middle School Subdivision located at 231 S. Constitution Drive and 233 S. Constitution Drive.
BACKGROUND:
The Subject Site is located at 231 S. Constitution Drive and 233 S. Constitution Drive. The Petitioner is requesting approval of a Final Plat. The site currently consists of the Washington Middle School, athletic fields and courts owned by the Fox Valley Park District, parking lots, and the Aurora Public Library - West Branch. The site consists of 3 PINs, each owned by West Aurora School District 129, Fox Valley Park District, and Aurora Public Library District.
The Final Plat proposal involves subdividing the property so that the lot lines between the School District and the Park District are consistent with their current improvements, particularly the tennis courts which are the property of the Park District. The Final Plat will also dedicate a cross access and parking easement over the parking lot, a blanket city easement to cover the existing utilities and a stormwater control easement over the detention pond.
DISCUSSION:
Staff has reviewed the Final Plat Resolution petition and have sent comments back to the petitioner on those submittals. The petitioner is working on making the requested revisions to these documents to meet the applicable codes and ordinances.
POLICIES AND GUIDELINES:
The Staff’s Evaluation and Recommendation are based on the following Physical Development Policies:
10.0 To provide for the orderly, balanced and efficient growth and redevelopment of the City through the positive integration of land use patterns, functions, and circulation systems.
11.0 To guide the growth of the City in an orderly and structured manner.
80.1 (1) To cooperate with the Fox Valley Park District, the school districts and the County Preserve Commission in meeting the open space and recreational needs of the City.
RECOMMENDATIONS:
The Planning and Zoning Commission recommended APPROVAL of the Resolution Approving the Final Plat of Subdivision for Washington Middle School Subdivision located at 231 S. Constitution Drive and 233 S. Constitution Drive.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, by petition dated January 12, 2026, West Aurora School District #129, Fox Valley Park District, and Aurora Public Library filed with the City of Aurora a petition requesting approval of a Final Plat for Washington Middle School Subdivision located at 231 S. Constitution Drive and 233 S. Constitution Drive and related required documents as attached hereto as Exhibits "A"; and
WHEREAS, the Planning and Zoning Commission conducted a hearing on January 21, 2026, reviewed the petition and recommended APPROVAL of said petition; and
WHEREAS, on January 28, 2026, the Building, Zoning and Economic Development Committee of the Aurora City Council reviewed said Final Plat and the before mentioned recommendations and recommended APPROVAL of said petition; and
WHEREAS, the decision of the Building, Zoning and Economic Development Committee with respect to a Final Plat is subject to appeal to the City Council in the manner set forth in Chapter 43 of the Code of Ordinances, City of Aurora, Illinois, being the Subdivision Control Ordinance; and
WHEREAS, no person authorized under the Subdivision Control Ordinance, to appeal such decision having done so in the manner set forth in the Code, the Decision of the Building, Zoning and Economic Development Committee constitutes final action on the proposed final plat; and.
NOW, THEREFORE, BE IT ORDAINED by the Building, Zoning and Economic Development Committee of the City of Aurora, Illinois, finds as facts all of the preamble recitals of this Resolution and hereby grants APPROVAL of said Final Plat.
BE IT FURTHER RESOLVED that the Building, Zoning and Economic Development Committee of the City of Aurora hereby adopts the Final Plat and related required documents as attached hereto as Exhibit "A" Final Plat along with any easement dedications deemed necessary by the Aurora City Engineer.
