Resolution Accepting the ComEd Customer Work Agreement for the Relocation and Undergrounding of the Overhead Electric Utility Lines for the ATC Regional Transportation Improvements Project (Commonwealth Edison - 17-00268 /AU22/2-17.012-AG/C - SP - Ward 1)
PURPOSE:
This ComEd Work Agreement allows for the relocation and undergrounding of the existing overhead electric utility lines within the project boundaries of the ATC Regional Transportation Improvements Project.
BACKGROUND:
The proposed utility work is part of the Aurora Transportation Center (ATC) Regional Facilities Enhancement Project (CIP A059). Located in downtown Aurora, the proposed improvements will help serve as a catalyst to future development. The project is comprehensive in nature and focused on renovating Broadway / IL Route 25, the ATC parking facilities, and providing a bicycle/pedestrian bridge that will span the Fox River. The vehicular improvements will include the relocation of the existing Pace Bus staging area and traffic signal to the main ATC parking facility, the reconfiguration parking stalls to add efficiency, a landscaped median in Broadway, and additional parking stalls in Lot W. The new bicycle/pedestrian bridge will provide access to the west side of the river, connect two regional trails, and provide access to additional parking for the ATC and RiverEdge Park.
The fifteen million dollar project will be largely funded by the CMAQ funds ($8.65M) with additional funding from the Kane County Forest Preserver ($2M), and the remaining ($4.45M) to come from the Transit Center Fund, TIF Funds and other future grants.
Staff has been working with its engineering consulting team to advance the Phase I and II design for the ATC Regional Facility Enhancement Project, and the project is currently slated for the 2019 CMAQ funding cycle, however the project is on target to be "shovel ready" in time for the 2018 funding cycle and Staff will be requesting that the project be moved up into that cycle. If successful in doing so the 18 month construction process is planned to commence in early 2018 after a late 2017/early 2018 bid process.
DISCUSSION:
The ComEd Customer Work Agreement is valid for 60 days from the date of its issuance being March 3, 2017. The scope of work for the project pursuant to the ComEd agreement calls for removal of 13 poles, multiple wires, cross arms and switches, the undergrounding of approximately 2,170 feet of cable and conduit and the relocation of 3 overhead transformers and 1 pad mounted transformer. The scope also calls for switchgear splices and terminations. The total estimated cost for the ComEd work is $685,000.00, with a fifty percent (50%) deposit estimated in the amount of $342,500.00 due prior to construction and the balance due upon completion. Upon the execution of the agreement and payment of a $60,000 non-refundable engineering charge by the City, ComEd will begin their engineering work, make a final determination of costs, and project planning and co-ordination with the City. The engineering fee will be applied towards the total project cost if the City authorizes the construction to proceed. The construction will be coordinated so as not to impact the 2017 RiverEdge Park season with work commencing no earlier than September of 2017. The work contemplated in this agreement was included in the approved 2017 A059 CIP budget and the account from which the project is to be funded is 353-4433-437.73-20.
IMPACT STATEMENT:
The Planning and Zoning Division would anticipate that this project will increase the City’s overall tax base and viability by facilitating investment and development which will offset any incidental Department or staffing impacts of coordinating the project with ComEd.
RECOMMENDATIONS:
Staff would recommend APPROVAL of the Resolution Accepting the ComEd Customer Work Agreement for the Relocation and Undergrounding of the Overhead Electric Utility Lines for the ATC Regional Transportation Improvements Project.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, the City desires to initiate the relocation and undergrounding of the existing overhead utility lines within the ATC Regional Transportation Improvements Project area; and
WHEREAS, at the direction of the City, ComEd has developed a utility relocation plan, a cost estimate for said relocation and produced a Customer Work Agreement as detailed in the attached proposal included herein as Exhibit A; and
WHEREAS, the 2017 City Budget provides the $685,000.00 for this item in account no. 353-4433-437.73-20.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that the City Council does hereby approve the ComEd Customer Work Agreement included herein as Exhibit A in an amount not to exceed $685,000.00 and does hereby further authorize the Mayor to execute said proposal upon passage of this Resolution.
