A Resolution Authorizing a Revised Intergovernmental Agreement between the City of Aurora and Village of North Aurora Regarding Mitchell/Hart Road, Sullivan Road, Deerpath Road and Orchard Gateway Road located along the Boundary Agreement line with North Aurora (The Village of Aurora - 26-0545 / KDWK-26.279-AG/R  

 

PURPOSE:

The purpose of this Resolution is to update the Intergovernmental Agreement between the City of Aurora and Village of North Aurora with regards to access and improvements, including cost related thereto, for Mitchell/Hart Road, Sullivan Road, Deerpath Road and Orchard Gateway Road located along the Boundary Agreement line with North Aurora.  

 

BACKGROUND:

The City of Aurora and Village of North Aurora originally entered into this intergovernmental agreement on January 28, 2003, by R03-08.  Subsequently, on November 27, 2007, a revision to this intergovernmental agreement was approved by City Council by R07-555.

 

The Village of North Aurora has requested an update to the Intergovernmental Agreement, specifically regarding Mitchell/Hart Road. The Village of North Aurora and the City of Aurora recently amended their Boundary Agreement along Hart Road, north of Butterfield Road. This amendment created a “Flex Parcel,” meaning the property may be annexed into either the City of Aurora or the Village of North Aurora.

 

As a result of this change to the Boundary Agreement, the road responsibilities for this portion of Hart Road need to be updated as the specific responsibilities will depend on which municipality ultimately annexes the property.

 

The agreement also updates the responsibilities for intersection improvements at State Route 56 and Mitchell/Hart Road and updates the shared responsibilities if/when signalization improvements for required for Mitchell Road and Corporate Boulevard intersection.

 

Lastly, the access locations along the east and west side of Mitchell Road are being updated as the access points are either existing or their locations have already been determined. 

 

DISCUSSION:

Both municipalities have reviewed the Intergovernmental Agreement and agree with the revisions. 

 

IMPACT STATEMENT:

By not updating the Intergovernmental Agreement, this could affect the development of future properties along the boundary line between the City of Aurora and the Village of North Aurora.  

 

RECOMMENDATIONS:

Staff recommends APPROVAL of the Resolution Authorizing a Revised Intergovernmental Agreement between the City of Aurora and Village of North Aurora Regarding Mitchell/Hart Road, Sullivan Road, Deerpath Road and Orchard Gateway Road located along the Boundary Agreement line with North Aurora.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, the City of Aurora (hereinafter “CITY”) and the Village of North Aurora (hereinafter “VILLAGE”) are each legal entities organized and existing under the laws of the State of Illinois, having among their powers the authority to contract with one another to perform the undertaking described herein; and

 

WHEREAS, the CITY and VILLAGE are public agencies within the meaning of the Illinois Intergovernmental Cooperation Act as provided for in 5 ILCS 220/1, et seq.; and

 

WHEREAS, the purpose of the Intergovernmental Cooperation Act and Article 7, Section 10 of the 1970 Constitution of the State of Illinois include fostering cooperation among units of local government in planning and providing services to their constituents; and

 

WHEREAS, the CITY and VILLAGE enter into the original intergovernmental agreement on January 28, 2003, by R03-008 and subsequently entered into a revised intergovernmental agreement on November 27, 2007, by R07-555; and

 

WHEREAS, the CITY and VILLAGE seek to enter into a revised intergovernmental agreement regarding access and improvements, including costs related thereto, for Mitchell/Hart Road, Sullivan Road, Deerpath Road and Orchard Gateway Road; and

 

WHEREAS, the City Council of the City of Aurora has determined that it is in the best interest of the City and its residents to enter into this Agreement; and

 

WHEREAS, the City Council has reviewed and approved the attached Intergovernmental Agreement. 

 

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Aurora, Illinois, as follows: that the Revised Intergovernmental Agreement as attached hereto as Exhibits "A" between the CITY and VILLAGE regarding Mitchell/Hart Road, Sullivan Road, Deerpath Road and Orchard Gateway Road located along the Boundary Agreement line with North Aurora be approved, and the Mayor of the City of Aurora is hereby authorized and directed to execute the Intergovernmental Agreement on the behalf of the City.

 

NOW THEREFORE, BE IT FURTHER RESOLVED that City Clerk be directed to transmit certified copies of this Resolution and the attached Intergovernmental Agreement to the Village of North Aurora with copies to the City of Aurora Corporation Council and the Finance Director.
