A Resolution Authorizing the Mayor and City Clerk to Execute the Engineering Agreement with Civiltech Engineering, Inc. and to Appropriate Motor Fuel Tax Funds for the 2014 Street Resurfacing Projects  
 
PURPOSE:
During construction it is important to have personnel on-site to observe the contractor's operations for compliance with the plans and specifications.   The City of Aurora hires additional personnel to assist city staff with this work.
 
BACKGROUND:
The Engineering Department received 10 SOI (Statements of Interests) from consultants in response to our request to fill the position of 2014 Street Resurfacing Project - Resident Engineer.  The SOI's were reviewed by a 3 personnel team and 3 firms were selected for interviews and submission of their qualifications.  Based on the results, Civiltech Engineering, Inc. was selected to provide a Resident Engineer for the 2014 Resurfacing Projects.  
 
DISCUSSION:
The attached Engineering Services Agreement from Civiltech is attached (Exhibit 'A').  This agreement details the scopes of services to be performed which include construction supervision, material inspection and documentation in an amount not to exceed $148,978.00.  Civiltech has designated Arthur Politowicz, P.G. as the Resident Engineer for this project.  Art has over 20 years of experience as a Resident Engineer, is very familiar with these types of projects and lives in Aurora.  In addition, Civiltech has reduced their overall billing factor and administrative costs for this agreement.
 
The 2014 Resurfacing Projects will include approximately $2,850,000 of Motor Fuel Tax (MFT) funded construction in addition to these engineering costs. The Illinois Department of Transportation requires the appropriation of MFT funds by Resolution prior to their expenditure.  The MFT Resolution in the amount of $3,000,000 (Exhibit 'B') is attached. The 2014 City Budget provides $3,000,000 for this item in account no. 203-4460-431-76.09 (MFT Funds).

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
 
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
 
WHEREAS, it is necessary and desirable to have an Engineering Agreement for the 2014 Resurfacing Projects; and
 
WHEREAS, there is a need for an Engineering Agreement with Civiltech Engineering, Inc., 450 E. Devon Avenue, Suite 300, Itasca, IL in an amount not to exceed $148,978.00, a copy of which Agreement is attached hereto and incorporated herein as Exhibit 'A'; and
 
WHEREAS, there is a need to appropriate $3,000,000 of Motor Fuel Tax funds by IDOT Resolution for the 2014 Resurfacing Projects expenditures, a copy of which IDOT Resolution is attached hereto and incorporated herein as Exhibit 'B'; and
 
WHEREAS, the 2014 City Budget provides $3,000,000 for this item in account no. 203-4460-431-76.09 (Motor Fuel Tax Funds) for this project)
 
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that the Mayor and City Clerk are hereby authorized to execute the Engineering Agreement with Civiltech Engineering, Inc. as set forth in Exhibit 'A' and the appropriation of Motor Fuel Tax funds as set forth in Exhibit 'B' for the 2014 Resurfacing Projects is hereby approved.
