A Resolution Approving a Final Plan on Lot 1 and Lot 2 of Femosh Subdivision located on the west side of Elder Drive between Birch Lane and Foxcroft Drive (Femosh Concepts LLC - 17-00487 / AU07/4-16.192-Fsd/Fpn - JM - Ward 5)
PURPOSE:
The Petitioner Femosh Concepts LLC is requesting approval of a Final Plan for Lot 1 and Lot 2 of Femosh Subdivision located on the west side of Elder Drive between Birch Lane and Foxcroft Drive for a Two Family Dwelling (1120) Use which includes the construction of a 4,528 square foot duplex.
BACKGROUND:
The Subject Property is currently Vacant Land/Open Space with R-5 (S) zoning, which is part of the Foxcroft Subdivision Special Use Planned Development. Additional information on the legislative history of the property can be found in the attached Property Information Sheet.
The Petitioner is requesting approval of a Final Plan for Lot 1 and Lot 2 of Femosh Subdivision for a Two Family Dwelling (1120) Use. The details of the request include the construction of a 4,528 square foot duplex. The plan includes a two-car garage per unit and a rear deck. The building elevations show brick on the first-story front façade with siding on the second-story and remaining elevations.
Concurrently with this proposal, the Petitioner is requesting approval of a Final Plat for Lot 1 and Lot 2 of Femosh Subdivision. The details of the request include the subdivision of three lots into two lots.
DISCUSSION:
Staff has reviewed the Final Plan petition and have sent comments back to the petitioner on those submittals. The petitioner has made the requested revisions to these documents and they now meet the applicable codes and ordinances, with the exception of the items mentioned in the Staff Recommendation listed below.
POLICIES AND GUIDELINES / IMPACT STATEMENT:
The Staff’s Evaluation and Recommendation are based on the following Physical Development Policies:
11.1 (3) To encourage new development contiguous to existing development.
11.1 (5) To guide and promote development to areas where public utilities, public roads and municipal services are either available or planned.
12.1 (9) To guide development and redevelopment into energy efficient land use patterns.
RECOMMENDATIONS:
The Planning Commission recommended CONDITIONAL APPROVAL of the Resolution Approving a Final Plan on Lot 1 and Lot 2 of Femosh Subdivision located on the west side of Elder Drive between Birch Lane and Foxcroft Drive, with the following condition:
1.) That a Landscape Implementation Plan will be submitted at time of Building and Permits reflecting the 3 CTE requirements of Section 7.3-4 Infill Housing Standards.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, by petition dated May 25, 2017, Femosh Concepts LLC filed with the City of Aurora a petition requesting approval of a Final Plan for Lot 1 and Lot 2 of Femosh Subdivision located on the west side of Elder Drive between Birch Lane and Foxcroft Drive for a Two Family Dwelling (1120) Use and related required documents as attached hereto as Exhibits "A-1" through Exhibit “A-2”; and
WHEREAS, after referral of said petition from the Aurora City Council, the Aurora Planning Commission on June 21, 2017, reviewed the petition and recommended CONDITIONAL APPROVAL of said petition; and
WHEREAS, on June 29, 2017, the Planning and Development Committee of the Aurora City Council reviewed said Final Plan and the before mentioned recommendations and recommended CONDITIONAL APPROVAL of said petition; and
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Aurora, Illinois, finds as facts all of the preamble recitals of this Resolution and hereby grants CONDITIONAL APPROVAL of said Final Plan with the following condition:
1.) That a Landscape Implementation Plan will be submitted at time of Building and Permits reflecting the 3 CTE requirements of Section 7.3-4 Infill Housing Standards.
BE IT FURTHER RESOLVED that the City Council of the City of Aurora hereby adopts the Final Plan and related required documents, as attached hereto as Exhibit "A-1" Final Plan and Exhibit “A-2” Building and Signage Elevations, along with any dedications or modifications deemed necessary by the Aurora City Engineer.
