SUBJECT:

A resolution to make additional payments to Hertz Local Addition, Des Plains, Illinois for rental vehicles for the Aurora Police Department to be recommended to the Finance Committee on August 23, 2016.

 

PURPOSE:

To increase purchase order 282573 from $25,000 to make additional payments to the Hertz Local Addition, Des Plains, Illinois for vehicles that will be leased or have been leased from Hertz in the amount up to $20,000.00. These vehicles are currently used for undercover investigations and operations by the Special Operations Group (SOG), Investigations and the Community Oriented Policing (COP) units.

 

BACKGROUND:

Since March, 2012 The Aurora Police Department has been leasing vehicles from Hertz Local Addition, Des Plains, Illinois following an RFP solicitation and City Council approval (Resolution R12-078). The contract with Hertz Local Addition expired at the end of 2015, therefore in the spring of 2016 another RFP was announced; the end result was Enterprise Leasing of Chicago had the lowest, most responsible bid. Enterprise Leasing was awarded the contract with but delays with Enterprise caused the Aurora Police Department to continue to lease vehicles from Hertz Local Addition. It is projected that the Aurora Police Department will still be leasing vehicles from Hertz for up to sixty additional days, which has exceeded our $25,000.00 threshold set for 2016. It is estimated that payment to Hertz should not exceed $20,000.00.

 

DISCUSSION:

It is imperative that the Aurora Police Department continue to use unmarked / undercover (leased) vehicles for undercover operations and covert investigations. Therefore it would not have been practical to discontinue the used of unmarked / undercover leased vehicles from Hertz Local Addition, Des Plains, Illinois:

The funds needed to continue payment to Hertz Local Addition for leased unmarked / undercover vehicles are available and have been paid out of General Fund Account: 101-3536-421.39-03 and Federal Forfeiture Account: 217-3536-421.39-03.

 

IMPACT STATEMENT:

The impact to the general public; if the Aurora Police Department was not allowed to continue the leasing of and the payment to Hertz Local Addition, would be a lapse in undercover / covert police operations which would additionally and negatively impact the Aurora Police Department.

At this time there is no additional cost to the Aurora Police Department.

 

RECOMMENDATIONS:

I recommend that the Finance Committee approve a two month extension of payment to Hertz Local Addition, Des Plains, Illinois for the lease of unmarked / undercover vehicles to the Aurora Police Department.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, The Aurora Police Department wishes to continue to lease and pay for vehicles from Hertz Local Addition for the next two months; and

 

WHEREAS, the 2016 budget provided $25,000.00 for the lease of vehicles from Hertz Local Addition, however, with delays in the approval of a new agreement with another leasing agency, it is estimated an additional $20,000.00 be approved to continue payment to Hertz; and

 

WHEREAS, the additional funds, in the amount of $20,000.00 will come from two accounts, 101-3536-421.39-03 (General Fund) and 217-3536-421.39-03 (Federal Forfeiture Funds). 

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: Approve a two month extension of payment to Hertz Local Addition, Des Plains, Illinois in the amount of $20,000.00 for the rental of vehicles for the Aurora Police Department and does hereby further authorize the director of purchasing to issue the necessary orders to implement purchase of the same.

 

Hertz currently has a past due balance with the city in the amount of $3,035.00.  The city intends to offset this amount with our payment to Hertz.
