SUBJECT:
An Ordinance Amending Chapter 20, Section 20-2 of the Aurora Code of Ordinances Entitled "Environmental Refuse Disposal Fee"
 
PURPOSE:
To obtain the City Council's approval of a proposed ordinance that would revise the rate of the environmental refuse disposal fee (ERDF).
 
BACKGROUND:
On December 18, 2007, the city established the ERDF through the City Council's adoption of Ordinance No. O07-148.  The ERDF covers the cost of picking up and disposing of:
 
      Â·      Unlimited brush from the first week in April through the first week in November  each year.
      Â·      Bagged yard waste during a designated two-week period in the spring each year.
      Â·      Leaves during a designated eight-week period each year.
      Â·      Natural Christmas trees.
      Â·      Unlimited recyclable materials year round.
 
On July 1, 2014 with the adoption of Ordinance No. O14-037, the city amended the rate of the ERDF to be $3.50 per dwelling unit per month effective July 1, 2014.
 
The ERDF generates a total of about $1.8 million annually.
 
DISCUSSION:
The city's current refuse disposal contract will expire on June 30, 2015.  The City Council recently approved a new contract to be effective through June 30, 2022.  To cover costs contemplated in the new contract, the monthly ERDF should be raised to the amounts indicated below per residential unit.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
 
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
 
WHEREAS, in accordance with the Extension of the Agreement with Allied Waste Disposal Services, LLC, approved by the City Council via Resolution R15-344, the base rate cost has changed for the period commencing July 1, 2015 and continuing up to, and including, June 30, 2022; and
 
WHEREAS, therefore the City's "Environmental Refuse Disposal Fee" as provided for in Section 20-2 of Chapter 20, as amended herein, shall be billed on a bi-monthly basis and invoiced upon the bi-monthly water bill for each residential unit, as provided therein.
 
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Aurora, Illinois, as follows:
 
      Section One:            That Chapter 20, Section 20-2 entitled "Environmental Refuse Disposal Fee" of the Aurora Code of Ordinances shall be amended as follows:
 
 
      Sec. 20-2.      Environmental Refuse Disposal Fee
 
      The owner or occupant of each residential building or residential unit receiving refuse and yard waste collection service under the provisions of this chapter shall pay an environmental refuse disposal fee in the amount set forth herein, such fee shall be billed on a bi-monthly basis and shall be invoiced upon the bi-monthly water bill for the residential building or residential unit as follows:
 
Effective July 1, 2015 through June 30, 2017:  $3.70 per unit per month
Effective July 1, 2017 through June 30, 2019:  $3.90 per unit per month
Effective July 1, 2019 through June 30, 2021:  $4.10 per unit per month
Effective July 1, 2021: $4.30 per unit per month
Seniors aged 65 and over are eligible for a senior discount of $1.00 per month

      Section Two:            That this ordinance shall be in full force and effect, and shall be controlling, upon its passage and approval.
 
      Section Three:      Those sections, paragraphs, and provisions of the City of Aurora Code of Ordinances which are not expressly amended or repealed by this Ordinance are hereby re-enacted, and it is expressly declared to be the intention of this Ordinance not to repeal or amend any portions of the City of Aurora Code other than those expressly amended or repealed in Section One of this Ordinance.
 
      Section Four:            That any Section or provision of this Ordinance that is construed to be invalid or void shall not affect the remaining Sections or provisions which shall remain in full force and effect thereafter.
