A Resolution authorizing the Mayor to execute an amendment to the 2006 agreement for the North Aurora Road Underpass between the City of Aurora, City of Naperville, and Naperville Township Road District and the corresponding MFT Appropriation.
PURPOSE:
To seek authorization of an amendment to the 2006 agreement for the North Aurora Road Underpass between the City of Aurora, City of Naperville, and Naperville Township Road District to acquire right of way and the corresponding MFT Appropriation.
BACKGROUND:
In 2006 the City entered into an agreement for the pursuit of the widening of the E,J&E viaduct crossing for the extension of the 5 lane section of North Aurora Road through the City of Aurora limit to City of Naperville. This segment includes the portion of township road under the current jurisdiction of the Naperville Township Road District. A phase 1 study was completed that included a proposed improvement and right of way requirements. As part of the agreement the City of Naperville was assigned lead agency.
Since 2006, both the City of Aurora and the City of Naperville have made improvements within their respective jurisdictions to the North Aurora Road corridor.
The current amendment is limited to acquisition of land required for future improvements.
DISCUSSION:
Under the proposed amendment the City would enter into an agreement to acquire the right of way for the proposed improvements. The City would be required to front $48,600.00 for negotiation services and two additional payments of $160,000.00 and $164,000.00 for anticipated actual right of way cost. The total front cost of the agreement to the City of Aurora is $312,600.00. The estimates provided are based on the provided Negotiation Services Agreement and land acquisition estimates.
Should actual cost be less the City will be reimbursed. Should actual cost be greater, the City will be subject to actual cost as outlined in the agreement.
The City has provided funding by way of the City of Aurora FY 2015 budget in the following account:

The intent is to have a completed Phase 1 study and acquired right of way, in order to better position the project for federal and state grant eligibility. Without substantial grant funding, the City is not in the position to move the construction of this project forward.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, there exist a need for the widening of the North Aurora Road Underpass a the railroad crossing previously known as the EJ&E Railway, and
WHEREAS, City desires to pursue acquisition of right of way for said improvements, and
WHEREAS, there is a need to appropriate Motor Fuel Tax Funds in the amount of $312,600.00, acopy of which resolution is attached hereto and incorporated herein as Exhibit 'C', and
WHEREAS, The City has provided funding by way of the City of Aurora FY 2015 budget in the following account:
