SUBJECT:

Resolution authorizing the City of Aurora and Fox Valley Park District to enter into a non-exclusive license to use the FVPD Parcel located at 600 S. River St. for a parking lot for an initial term of ten years, with the option to be renewed for up to three successive five-year terms.

 

PURPOSE:

To obtain City Council approval to reauthorize a land use development agreement between the City of Aurora and the Fox Valley Park District which will allow for the agreed continued use of land for a portion of the parking lot which services the Aurora Animal Control and Care Facility and the Fox Valley Park District Dog Park (see exhibit A).

 

BACKGROUND:

Approximately 10 years ago, the City of Aurora and Fox Valley Park District entered into an agreement to expand the parking lot due to an increase in activities at Aurora Animal Care and Control.  The City expanded the parking lot on Fox Valley Park District property and has maintained the property for the last 10 years.

 

DISCUSSION:

This agreement will re-authorize the City to maintain an asphalt parking lot that can be used by visitors of the Animal Care and Control in exchange for granting access and parking rights to the general public for use of the Fox Valley Park District dog park.

 

IMPACT STATEMENT:

This agreement will re-authorize access for additional parking and the city will maintain the parking lot.

 

RECOMMENDATIONS:

City staff recommends approval.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, the City of Aurora Animal Control and Care Facility, located at 600 S River Street is still in need of additional parking; and

 

WHEREAS, the Fox Valley Park District which owns land immediately south of the Aurora Animal Control and Care Facility's parking lot has agreed to allow the City to the parking lot that can be used by visitors and volunteers of the Aurora Animal Care and Control Facility in exchange for granting access and parking rights to the general public; and

 

WHERAS, FVPD hereby grants to the City a non-exclusive license to use the FVPD Parcel for Parking Lot for an initial term of ten (10) years, subject to the terms hereof.  After the initial term, the term shall be renewed for up to three (3) successive five (5) year terms, unless a party gives notice of termination to the other at least ninety (90) days from the end of the then current term.)

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: the Mayor and City Clerk are hereby authorized to sign the attached License Agreement with Fox Valley Park District.
