A Resolution Approving the Final Plan on Lot 5A, 6A, 7A, and 10 for Unit Two of the Resubdivision of Deerpath Commerce Center Subdivision being Vacant Land located at the southwest corner of Orchard Gateway and Deerpath Road, Aurora, Illinois 60506  (PPG/Conor Commercial Real Estate - L15-00408 / SG01/4-15.088-Fpn/Fsd/R - TV - WARD 5)  

 

PURPOSE:

The Petitioner, Conor Commercial Real Estate is requesting approval of a Final Plan for Lot 5A, 6A, 7A, and 10 for Unit Two of the Resubdivision of Deerpath Commerce Center Subdivision which includes the construction of stormwater facilities and construction of a warehouse facility on the property located at the southwest corner of Orchard Gateway and Deerpath Road.  

 

BACKGROUND:

The Operator, PPG Industries, Inc. (“PPG”), is a Fortune 500 company and an American global supplier of paints, coatings, optical products, specialty materials, glass and fiberglass and are currently located on Bilter Road, in the Liberty Business Park in Aurora.  They recently acquired the company Homax including its facility in Joliet and are looking for a new location since the current Aurora site does not have the capacity to accommodate the Joliet operations.  The Petitioner has been working with Seize the Future on finding another site within the City of Aurora and decided on the Subject Property which is 47.66 acres located at the southwest corner of Orchard Gateway and Deerpath Road.  The property is currently vacant with ORI(S) Office, Research, and Light Industrial zoning which is part of the Orchard Gateway Corporate Centre Special Use Planned Development.  The Original Orchard Gateway Corporate Centre Special Use Planned Development was approved in 2003 which allowed for certain educational services for Aurora Christian. In 2009, Aurora Christian decided to no longer pursue a new school facility on this site so a portion of the property was rezoned to add the flexibility of B-2(S) zoning and limited certain industrial trade uses.  Earlier this month, the Plan Description was revised to allow for the expansion of the ORI Office/Research/ Light Industry uses and a Preliminary Plan and Plat revision was approved.

 

The details of the Final Plat Revision includes resubdividing Lot 5, 6, and 7 of the Deerpath Commerce Center Unit 2 being 47.66 acres to create four lots.  Lot 5A & Lot 10 contains stormwater facilities while Lot 6A contains compensatory storage. Lot 7A creates a buildable lot for office/warehouse uses.

 

The details of the Final Plan includes the construction and expansion of stormwater facilities on Lot 5A & Lot 10 and the reconfiguration of the compensatory storage on Lot 6A.  Lot 7A contains a 304,560 square foot facility with the ability for a 159,800 square foot building expansion.  This facility will house several of PPG’s operations.   The combined business within the proposed building will supply products to national accounts, shipping approximately 12 million gallons and 2.8 million cases of product annually. In addition, this facility will handle the shredding and recycling of 120,000 gallons of paint annually. PPG collects paint pails from their customers that are shred on site to recycle into new pails. A 2,400 square foot area will be dedicated to a tinting operation. Within the space there will be five different tinting systems used to provide custom paint orders. In the larger open area of the facility, goods will be packaged into larger kits to provide along with a paint order. Lastly, a portion of the 58,000 square foot room used to store specialty paint products will have a relabeling operation that removes labels from a product and repackages it for shipment. The building will include three separate office areas totaling 7,000 square feet. The new operation is expected to bring a total of 75 warehouse employees plus 12 staff employees. The building is a single story cross-docked facility with the docks being on the east and west side of the building.   The trailer parking will be contained to the west side of the property.  There will be two accesses off Orchard Gateway Road and one access off of Deerpath Road which aligns with the commercial access across the street in North Aurora.  The plan indicate 293 automobile parking spaces, of which 213 will be banked for future need.  An undulating berm is being proposed along the east property line to help screen the building. The Petitioner is requesting a 6 ½ foot tall ground sign at the northeast corner of Lot 7A. 

 

The building elevation consists of stained precast-concrete wall panels with windows throughout the warehouse area.  The main office entry at the northwest corner has been enhanced with a glass-curtain wall and high-gloss corrugated metal panels which is immediately adjacent to the main entry on the north façade.  Additionally, there will be a string of windows on the west façade and a canopy will also be wrapped around the corner.  The northeast corner of the building has also been enhanced with high-gloss corrugated metal panel elements along the north and east facades. Additionally, portions of the walls in this area will have painted panels of color and grid that emulate the high-glass areas at the main entry.  A canopy will also be wrapped around the corner. 

 

Landscaping is being implemented throughout all of the lots.    

 

DISCUSSION:

 Staff has reviewed the Final Plan and Plat Revision petition, submitted by the petitioner and have sent comments back to them on those submittals.  The petitioner has made the requested revisions to these documents and they now meet the applicable codes and ordinances, with the exception of the items mentioned in the Staff Recommendation listed below. 

 

POLICIES AND GUIDELINES:

The Staff’s Evaluation and Recommendation are based on the following Physical Development Policies:

 

11.0                     To guide the growth of the City in an orderly and structured manner.

 

12.0                     To plan and provide for the growth of the city through the integration of land use patterns and functions that promotes complimentary interactions between different land use components.

 

40.1(1) To attract and encourage industrial, office and office-research development to planned sites where requisite public facilities are either present or proposed.   

 

RECOMMENDATIONS:

The Planning Commission recommends CONDITIONAL APPROVAL of the Resolution Approving the Final Plan on Lot 5A, 6A, 7A, and 10 for Unit Two of the Resubdivision of Deerpath Commerce Center Subdivision being Vacant Land located at the southwest corner of Orchard Gateway and Deerpath Road, Aurora, Illinois 60506, with the following conditions:

 

1.  That approval is contingent upon final engineering plan and stormwater management plan review.

 

2.  That a letter of map revision based on Fill (LOMR-F) from FEMA is require and will be a contingent for final acceptance and issuance of final certificate of occupancy. 

 

3.  That the Engineering Plan detailing the watermain connection be submitted to the Village of North Aurora for review and approval.  Any watermain connection fee, required by Village of North Aurora, will need to be paid prior to final engineering plan approval.   Approval letter and copy of payment from the Village of North Aurora shall be provided to the City.

 

4.  That 15 Evergreens/Ornamental and 80 Shrubs be added around the foundation to meet the City's landscaping requirement.

 

5.  That 3 canopy trees be replaced with 80 shrubs around stormwater facilities to meet the City's landscape requirement.

 

6.  That 5 canopy trees equivalents per 100 feet of high water line be planted around the perimeter of Lot 6A to meet the City's landscape requirement, of which a minimum of 25% of the required canopy tree equivalent shall be non-canopy tree planting material.

 

7.  That the Honeylocust street tree should be removed and replaced with a tree species listed in the City’s Approved Street Tree Species list; see attached.

 

8.  That no genus shall account for more than 33% of any Planting Material Type and no more than three of the same species shall be clustered together.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, by petition dated April 2, 2015, Conor Commercial Real Estate filed with the City of Aurora a petition Requesting approval of a Final Plan for Lots 5, 6, and 7 of Deerpath Commerce Center Subdivision, Unit 2.

 

Requesting approval of a Final Plan for Lots 5, 6, and 7 of Deerpath Commerce Center Subdivision, Unit 2. and related required documents as attached hereto as Exhibits "A-1" through Exhibit “A-4”; and

 

WHEREAS, after referral of said petition from the Aurora City Council, the Aurora Planning Commission on July 22, 2015, reviewed the petition and recommended CONDITIONAL APPROVAL of said petition; and

 

WHEREAS, on July 30, 2015, the Planning and Development Committee of the Aurora City Council reviewed said Final Plan and the before mentioned recommendations and recommended CONDITIONAL APPROVAL of said petition; and   

 

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Aurora, Illinois, finds as facts all of the preamble recitals of this Resolution and hereby grants CONDITIONAL APPROVAL of said Final Plan with the following conditions:

 

1.  That approval is contingent upon final engineering plan and stormwater management plan review.

 

2.  That a letter of map revision based on Fill (LOMR-F) from FEMA is require and will be a contingent for final acceptance and issuance of final certificate of occupancy.

BE IT FURTHER RESOLVED that the City Council of the City of Aurora hereby adopts the Final Plan and Plat Revision and related required documents as attached hereto as Exhibit "A-1" Final Plan, Exhibit “A-2” Landscaping Plan, Exhibit “A-3” Building and Signage Elevations, Exhibit “A-4” Fire Access Plan along with any dedications deemed necessary by the Aurora City Engineer.
