SUBJECT:

A resolution Authorizing a Contract with Martam Construction Inc., 1200 Gasket Dr., Elgin, IL 60120 for the E. Galena Blvd. & E. Downer Pl. Sewer Separation, Water St. to State St. project in the amount of Nine Million, Eight Hundred Thousand, Nine Hundred and Eighty-Nine Dollars and Seventy Cents ($9,800,989.70), pending the approval of a loan from the Illinois Environmental Protection Agency (IEPA) Water Pollution Control Loan Program.

 

PURPOSE:

The construction of the proposed underground improvements will reduce the frequency of combined sewer flows discharged to the Fox River, reduce the number of basement back-ups and provide new water main along the corridor of the project.

 

BACKGROUND:

As part of the Clean Water Act, the Environmental Protection Agency created the National Pollutant Discharge Elimination System which resulted in several permits for the City of Aurora.  As part of one of these permits, the City was required to create a Long Term Control Plan (LTCP) to reduce pollutants entering the Fox River and Indian Creek from their combined sewer systems. This sewer separation project is a required milestone of the LTCP created by the City to satisfy the permit it holds with the IEPA. 

 

DISCUSSION:

This project is to be constructed in 2016 and 2017.  The current 2016 budget shows the full value of the Loan No. L175350 In account 281-1856-512-73-09 which will cover the approximate $6,758,000 cost for the storm sewer and sanitary sewer improvements.  The award of this contract will be contingent on the receipt of this loan from the Illinois Environmental Protection Agency.  Approximately $2,730,000 of the contract is to cover water main improvements along the project corridor, which will be covered by 2016 and 2017 funds from account 510-4058-511-73-02.  Finally, approximately $270,000 of the contract is to cover resurfacing and reconstruction of E. Galena Blvd. from Stolp to Water Street which will be covered by 2016 from funds account 340-4460-431-73-80 (CapA) - G016.  Fiber Optic Conduit Installation will be installed with OnLight Aurora, Invest Aurora, or account 231-1232-419-73-86 from TIF #1.  See attached Exhibit A for tabulation of bids received.

 

IMPACT STATEMENT:

During construction, there will be various roadway and lane closures, delays are to be expected.  The construction on LaSalle St. and E. Downer Place will result in the full reconstruction of those sections of roadway. 

 

RECOMMENDATIONS:

I recommend that this resolution be adopted.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, Martam Construction Inc. provided the lowest responsible bid of three (3) bidders, See attached Exhibit A for tabulation of bids received,

 

WHEREAS, the improvements are required as part of a permit the City holds with the EPA and the unfunded mandate required by the EPA.

 

WHEREAS, the project will be funded from the following accounts:

 

281-1856-512-73-09 = $6,758,000

510-4058-511-73-02 = $2,730,000

340-4460-431-73-80 (CapA) - G016 = $270,000

OnLight Aurora, Invest Aurora, or account 231-1232-419-73-86 from TIF #1 = $57,000

 

WHEREAS, the award of this contract will be contingent on the approval of IEPA loan No. L175350 ;

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that the Agreement with Martam Construction Inc., 1200 Gasket Dr., Elgin, IL 60120 in the amount of Nine Million, Eight Hundred Thousand, Nine Hundred and Eighty-Nine Dollars and Seventy Cents ($9,800,989.70), for the E. Galena Blvd. & E. Downer Pl. Sewer Separation, Water St. to State St. Project is hereby authorized, pending the approval of a loan from the Illinois Environmental Protection Agency (IEPA) Water Pollution Control Loan Program, and the Purchasing Director is hereby authorized to execute the necessary documents to implement said Agreement.
