SUBJECT:

A Resolution Approving a Final Plan for the Property Located on the South Side of New York Street and West of Welsh Drive, for a Car Dealership Entirely Used (2811) Use (Fox Valley Property Services, LLC - 17-00549 / AU24/4-17.053-Fpn - SB - Ward 7)  

 

PURPOSE:

The Petitioner, Fox Valley Property Services, LLC, is requesting approval of a Final Plan for the property located on the south side of New York Street and west of Welsh Drive, for a Car Dealership, Entirely Used (2811) use which includes the construction of a new, approximately 4,300 square foot, building and associated parking.  

 

BACKGROUND:

The subject property is currently vacant, with a B-2(S), Business District, General Retail zoning, which is part of the Fox Valley Square Special Use Planned Development.  A Preliminary Plat and Plan for the Planned Development was approved on April 25, 2017 with Resolution R2017-126, which included the subdivision of the property into 4 lots with lots 1 - 3 to be developed as commercial uses, and lot 4 which is anticipated to be dedicated to the Kane County Forest Preserve as open space.  Additional information on the legislative history of the property can be found in the attached Property Information Sheet.

 

The Petitioner is not subdividing the property at this time but is requesting approval of a Final Plan for the future Lot 1 of the Fox Valley Square subdivision.  The details of the request include the construction of a new 4,335 square foot building, and a total of 59 parking spaces.  The proposed building is 19'-9", and will be built with pre-cast concrete, thin brown-colored brick, and silver composite metal canopy. There is a proposed full access from East New York Street, which will be a shared access utilized by the entire future subdivision.  An eighteen (18) foot tall and seventeen (17) foot wide overall development monument sign is also proposed, which will be a shared sign utilized by the entire future subdivision therefore no more than one-third of the sign should be utilized by any one tenant or lot.   

 

DISCUSSION:

The proposed Final Plan is consistent with Lot 1 of the approved Preliminary Plan and Plat, and it is not necessary to subdivide the property until such time as a second lot is developed.  Staff has reviewed the Final Plan petition and have sent comments back to the Petitioner based on those submittals.  The Petitioner has made the requested revisions to these documents and they now meet the applicable codes and ordinances. 

 

POLICIES AND GUIDELINES:

The Staff's Evaluation and Recommendation are based on the following Physical Development Policies:

 

10.0                     To provide for the orderly, balanced, and efficient growth and redevelopment of the City through the positive integration of land-use patterns, functions, and circulation systems.  To protect and enhance those assets and values that establish the desirable quality and general livability of the City.  To promote the City's position as a regional center.

11.1 (3): To encourage new development contiguous to existing development.

31.1 (3): To promote the development of commercial facilities in existing or planned commercial areas.  

 

RECOMMENDATIONS:

The Planning Commission recommended CONDITIONAL APPROVAL of the resolution approving a Final Plan for the property located at the south side of New York Street, and west of Welsh Drive for a Car Dealership, Entirely Used (2811) use, with the following conditions:

 

1) That no more than one-third of the overall development sign shall be utilized by any one tenant or lot.

2) That the property be subdivided, consistent with the Preliminary Plan and Plat, prior to the approval of any subsequent Final Plan on the Subject Property.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS by petition dated June 8, 2017, Fox Valley Property Services, LLC, filed with the City of Aurora a petition requesting approval of a Final Plan for the property located on the south side of New York Street, and west of Welsh Drive for Car Dealership, Entirely Used (2811) use and related required documents as attached hereto as Exhibits "A-1" through Exhibit “A-3”; and

 

WHEREAS, after referral of said petition from the Aurora City Council, the Aurora Planning Commission on July 19, 2017, reviewed the petition and recommended CONDITIONAL APPROVAL of said petition; and

 

WHEREAS, on July 27, 2017, the Planning and Development Committee of the Aurora City Council reviewed said Final Plan and Plat and the before mentioned recommendations and recommended CONDITIONAL APPROVAL of said petition; and  

 

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Aurora, Illinois, finds as facts all of the preamble recitals of this Resolution and hereby grants CONDITIONAL APPROVAL of said Final Plan with the following conditions:

 

1) That no more than one-third of the overall development sign shall be utilized by any one tenant or lot.

2) That the property be subdivided, consistent with the Preliminary Plan and Plat, prior to the approval of any subsequent Final Plan on the Subject Property.

 

BE IT FURTHER RESOLVED that the City Council of the City of Aurora hereby adopts the Final Plan and related required documents, as attached hereto as Exhibit "A-1" Final Plan, Exhibit “A-2” Landscape Plan, and Exhibit “A-3” Building and Signage Elevations, along with any dedications or modifications deemed necessary by the Aurora City Engineer.
