SUBJECT:

An Ordinance Amending Chapter 13.5, Section 13.5-3 of the City of Aurora Code of Ordinances Entitled "Chief Examiner-Generally"

 

PURPOSE:

To update and codify the current practices in regards to the administrative support for the Civil Service Commission.

 

BACKGROUND:

For over 10 years, administrative support for the Civil Service Commission has been under the purview of Human Resources.  This has provided stronger oversight of the daily operational functions for the Civil Service Commission.

 

DISCUSSION:

The functionality of the Civil Service Commission has changed over time and the current language does not accurately reflect current practices.  The title Chief Examiner is obsolete. The Civil Service Assistant position has been the Commission’s only administrative support position and was moved into the Human Resources Department over five years ago. 

 

Over the years in order to increase efficiency, the Civil Service Assistant position has evolved to not only provide administrative support to Civil Service, but also to support Human Resources generally, such as handling workers compensation and OSHA compliance.  Similarly during Civil Service testing and other peak times, supplemental support is provided to the Civil Service Commission by additional Human Resources staff members. 

 

Given that the Civil Service position is currently vacant, it was both the desire of Human Resources and the Civil Service Commission to update the code to reflect current practices.  The code change will eliminate the positions of both the Civil Service Examiner and Civil Service Assistant.  After a review of the job responsibilities, the budgeted position of Civil Service Assistant (Grade 11) will be converted to a Human Resources Generalist (Grade 12).  This change brings Civil Service in line with other city boards and commissions, where support is provided by the appropriate City department versus dedicated commission staff. 

 

The proposed revisions are consistent with the mission and function of the Civil Service Commission.  The Civil Service Commission reviewed the changes at its meeting on Thursday, July 9, 2015 and concurred with staff that the code changes should be presented to City Council for consideration.

 

IMPACT STATEMENT:

Due to vacancy of the Civil Service Assistant position, no additional budgetary authority will be required in 2015.  Additional budgetary authority of approximately $8,000 will be required in 2016 and beyond to sustain this position.

 

RECOMMENDATIONS:

 Place on the Committee of the Whole agenda for approval.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, the City deems it necessary and appropriate to amend Chapter 13.5, Section 13.5-3 of the City of Aurora Code of Ordinances entitled “Chief Examiner Generally."

 

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Aurora, Illinois, as follows: 

Section One:                     That Chapter 13.5, Section 13.5-1 entitled “Chief Examiner Generally” shall be amended by deleting in its entirety the current provisions thereof, and replaced with a new Section 13.5-3 entitled “Civil Service Administrative Functions” as follows:

 

Sec. 13.5-3. Civil Service Administrative Functions

(a)                     All administrative functions of the civil service commission shall be performed by the Human Resources Department.  Such functions include, but are not limited to:

(1)                     Preparing, administering, supervising and grading all examinations held by the commission.

(2)                     Establishing and maintaining eligibility lists for appointments and promotions.

(3)                     Certifying to the appointing authority the names of persons who are qualified to fill a vacant position.

(4)                     Certifying the appointment, removal, suspension, promotion and transfer of all employees in classified service positions.

(5)                     Publishing notice of examinations and fees in accordance with section 13.5-8.

(6)                     Maintaining a manual of rules promulgated by the civil service commission pursuant to section 13.5-2.

(7)                     Distributing to all elected officials and department heads the manual of rules promulgated by the civil service commission and all amendments and changes thereto within fifteen (15) days of their effective date.

(8)                     Establishing and administering a plan, approved by the commission for resolving those employee grievances relating to matters of promotion, transfer, discharge and disciplinary suspensions subject to review by the commission.

(9)                     Establishing and administering procedures, approved by the commission, for disciplinary actions such as demotions in rank or pay grade or discharge which provide for presentation of charges, hearing rights and appeals for all employees in the classified service.

(10)                     Keeping minutes of all its proceedings, preserving all reports made to it and keeping records and copies of all examinations held under its direction.

(11)                     Performing other related duties as assigned.

 

Section Two:                                          That this Ordinance shall be in full force and effect, and shall be controlling immediately upon passage and approval.

 

Section Three:                     That all ordinances or parts of ordinances thereof in conflict herewith are hereby repealed to the extent of any such conflict.

 

Section Four:                                          That any Section or provision of this Ordinance that is construed to be invalid or void shall not affect the remaining sections or provisions which shall remain in full force and effect thereafter.
