An Ordinance Approving a Text Amendment to Ordinance Number 3100, being the Aurora Zoning Ordinance to modify Section 3.3. Definitions, Sec. 19.2 Adoption, and Table One: Use Categories, Regarding "Truck Stop Establishments" (City of Aurora - 16-00387 / KDWK-16.060-TXT/AZO - TV)  

 

PURPOSE:

The purpose of this proposed text amendment is to modify the Aurora Zoning Ordinance to add a use category for truck stop establishments and related regulations.  

 

BACKGROUND/DISCUSSION:

Staff is seeing a recently renewed trend in the development of fueling centers incorporating separate diesel fuel stations that are designed to accommodate semi-trucks and other commercial vehicles. One such facility was recently constructed at the northeast corner of Wolf's Crossing and Route 30 in Oswego.  Such facilities do not currently have a separate definition under our zoning ordinance.  Staff believes that this use is more intense than a typical gas station use and, therefore, would propose to define these type of uses as newly defined "truck stop establishments".

 

This text amendment would add a definition for truck stop establishments and classify them as a Special Use under the B-2, B-3, M-1 and M-2 zoning districts. 

 

RECOMMENDATIONS:

The Planning Commission recommends APPROVAL of the Ordinance Approving a Text Amendment to Ordinance Number 3100, being the Aurora Zoning Ordinance to modify certain portions being Section 3.3. Definitions, Sec. 19.2 Adoption, and Table One: Use Categories.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS,  the City Council has determined that it is  desirable to amend the Aurora Zoning Ordinance in order to provide a separate category of use entitled "Truck Stop Establishments" as distinct from regular and less intensive use gas stations; and

 

WHEREAS, on May 4, 2016, the Aurora Planning Commission, after publication of notice, held a public hearing on this amendment and recommended approval of the amendment attached hereto and incorporated herein as Exhibit “A”.

 

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Aurora, Illinois, as follows:

 

Section One: That the City Council of the City of Aurora, Illinois finds as fact all of the preamble recitals of this Ordinance.

Section Two: That the amendments to the City of Aurora Zoning Ordinance, Ordinance Number 3100, attached hereto and incorporated herein as Exhibit "A: are hereby approved.

Section Three: That this Ordinance shall be in full force and effect, and shall be controlling, upon its passage and approval.

Section Four: That all Ordinances or part of Ordinances in conflict herewith are hereby repealed insofar as any conflict exists. 

 

Section Five: That any section, phrase or paragraph of this Ordinance that is construed to be invalid, void or unconstitutional shall not affect the remaining sections, phrases or paragraphs of this Ordinance which shall remain in full force and effect.
