SUBJECT:

A Resolution Authorizing a Professional Services Agreement with Crawford, Murphy & Tilly, Inc., for the development of a Source Water Protection Plan for the Water Production Division.

 

PURPOSE:

To obtain City Council approval to execute a professional engineering services agreement with Crawford, Murphy & Tilly, Inc. (CMT), Aurora, IL, for the development of a source water protection plan.

 

BACKGROUND:

In August of 2019, Title 35 of the Illinois Administrative Code, Part 604 was enacted by the state of Illinois.  Subpart C of Part 604 requires all community water supplies treating surface or groundwater as a primary or emergency supply of water to develop a source water protection plan.  A community water system serving a population of greater than 50,000, such as the City of Aurora, must submit their Source Water Protection Plan (SWPP) to the Illinois Environmental Protection Agency by July 26, 2022.

 

DISCUSSION:

The activities involved to complete this unfunded regulatory requirement involve extensive research, data gathering, analysis, and finalization of the plan.  This effort goes beyond the internal resources of the Water Production Division (WPD).  Therefore, CMT was requested to submit a Scope of Services to meet the requirements of Subpart C.  Attached is a listing of the general requirements of the SWPP detailed in Subpart C, sections 604.300 through 604.340.

 

CMT has worked closely with the WPD on many water supply matters for many years.  The firm possesses the technical skill and, more importantly, source water familiarity with both the Fox River and the city's extensive well water network, which are critical to properly addressing the actual elements of the SWPP.  The WPD recommends that this project move forward with CMT in order to meet the requirements for a SWPP as well as the regulated statutory deadline. 

 

Supporting documents from CMT pertaining to this matter are attached and include Exhibit A (Scope of Services), Exhibit B (Cost of Services Estimate), Exhibit C (Hourly Billing Rates), Standard Agreement for Professional Services, and Standard General Conditions.  The not-to-exceed amount for this project is estimated by CMT to be $58,150.00.

 

Requested funding of $60,000.00 for this project is approved by a 2021 Decision Package and is available in the 2021 Budget in account No. 510-4058-511-32-07.

 

IMPACT STATEMENT:

Not completing the required SWPP by the statutory deadline would put the city out of compliance with state law.

 

RECOMMENDATIONS:

That a resolution authorizing the execution of a Professional Services Agreement with Crawford, Murphy & Tilly, Inc., in an amount not to exceed $60,000.00 be approved by the Mayor and City Council.  It is further recommended that this matter be submitted to the Finance Committee for review and recommendation.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, the City of Aurora is required to develop a Source Water Protection Plan under Illinois Administrative Code Title 35, Part 604, Subpart C; and

 

WHEREAS, professional services are needed to complete the development of a complete Source Water Protection Plan; and

 

WHEREAS, a proposal has been received from Crawford, Murphy & Tilly, Inc., to provide the necessary services for development of a Source Water Protection Plan; and

 

WHEREAS, funding for this project is included in the 2021 budget via an approved 2021 Decision Package and is available in account No. 510-4058-511-32-07;

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: A professional services agreement with Crawford, Murphy & Tilly, Inc., for the development of a Source Water Protection Plan in an amount not to exceed $60,000.00 is hereby authorized and the Purchasing Director is approved to execute all necessary documents in connection therewith.
