SUBJECT:

A Resolution amending Exhibit A, Section 2 of R13-033, regarding Motor Vehicles and Traffic Fees, Fines and Penalties for the City of Aurora.

 

BACKGROUND:

Chapter 27 of the City of Aurora Code of Ordinances entitled "Motor Vehicles and Traffic, Sec. 27-8 Fees, Fines and Penalties" notes that fees, fines and penalties for the chapter are set by Resolution or Ordinance. The most recent resolution establishing fees for this section is from 2013, R13-033, which is attached.   

 

DISCUSSION:

A multidisciplinary team of city staff members has been meeting to discuss winter parking procedures and how to better address cars parked on the street when there are more than two inches of snow. This team has made a number of recommendations, one of which is an ordinance amendment presented at the Tuesday, October 17 RAP Committee Meeting, as well as proposing an increase to the fee charged to for cars left on the street during snow operations. 

 

As outlined in the attachment, the snow parking violation amount was last updated in 2013. After reviewing neighboring municipalities rates, staff is recommending an increase from $25 to $40 per ticket. The late fee will follow the schedule outlined in Exhibit A, Section (3) a. This increased ticket fee is one of the recommendations to improve snow operations for the 2023-2024 snow season.

 

IMPACT STATEMENT:

The increase of this fee will support the removal of cars off the street during city snow operations, improving the quality of life for Aurora residents. 

 

 

RECOMMENDATIONS:

It is respectfully requested the updated snow parking violation fee be forwarded by the Finance Committee to the Committee of the Whole for full Council review and discussion.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, it is the city’s desire to improve snow operations when there is 2” of snow or more on the ground; and

 

WHEREAS, it is appropriate for the City of Aurora to update the fee related to the snow parking violation last updated in 2013.

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: upon passage of this Resolution, pursuant to Chapter 27, R13-033 is hereby repealed and replaced with "Exhibit A" pursuant to Chapter 27, Sec. 27-8., all previous rates pertaining to Sec. 27-8 are hereby repealed and replaced with “Exhibit A” upon passage of this resolution.
