An Ordinance Granting the removal of enclosed parking for property located at 1180 Morton Avenue, Aurora, IL 60506, in Kane County, Aurora Illinois  (Boreas, LLC - L14-00820 / AU16/1-14.290-V - ES - Ward 6) (PUBLIC HEARING)
  
 
PURPOSE:
The Petitioner, Boreas, LLC, is Requesting a Variance from the enclosed parking standards to convert an existing one car garage to living space at 1180 Morton Avenue The details of the proposal include converting the existing attached garage into living space to allow the home to be fully wheel chair accessible in conformance with federal regulations.   
 
BACKGROUND:
The redevelopment of 1180 Morton Avenue is one of 40 properties to be rehabilitated in a program called the Aurora Impact Initiative, in conjunction with the Aurora Housing Authority (AHA), to provide for replacement housing units for those units lost as a result of the demolition of Jericho Circle.  5% of the units are to be handicapped accessible, and this variance would facilitate that goal.  
 
DISCUSSION:
While the City is generally supportive of maintaining enclosed parking on residential properties, in this case, this house is at the end of a dead end street, allowing for some on street parking without leading to more congestion, and the 30' long driveway will also remain.  This conversion will also allow for handicapped accessibility.  
 
PHYSICAL DEVELOPMENT POLICIES:
12.1      (7)      To protect residential development from the negative effects of high volume traffic corridors and incompatible land uses.
12.1      (9)      To guide development and redevelopment into energy efficient land use patterns.   
 
RECOMMENDATIONS:
The Zoning Board of Appeals recommended APPROVAL of the An Ordinance granting the removal of enclosed parking for property located at 1180 Morton Avenue, Aurora, IL 60506, in Kane County, Aurora Illinois.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
 
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
 
WHEREAS, Boreas, LLC is the owner of record of the real estate commonly known as 1180 Morton Avenue, Aurora, IL 60506 and legally described on Exhibit "A", attached hereto and incorporated herein by reference as if fully set forth, has made application for a variation of Ordinance No. 3100, being the Aurora Zoning Ordinance, requesting a Variance from the enclosed parking standards to convert an existing one car garage to living space at 1180 Morton Avenue as provided by Section 5.13-3.1 Schedule of Parking Requirements of said Ordinance; and
 
WHEREAS, on 10/22/2014, the Zoning Board of Appeals of the City of Aurora held a public hearing and therein found that the requested variation met the standards prescribed by Section 5.13-3.1 Schedule of Parking Requirements of said Ordinance and therein and recommended APPROVAL; and
 
WHEREAS, on 10/30/2014, the Planning and Development Committee of the City Council of the City of Aurora reviewed the findings and recommendation of the Zoning Board of Appeals of the City of Aurora and recommended CONDITIONAL APPROVAL; and
 
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Aurora, Illinois, Section One: That the City Council of the City of Aurora, Illinois finds as fact all of the preamble recitals of this Ordinance.
 
Section Two: That the real property commonly known as 1180 Morton Avenue, Aurora, IL 60506 and legally described on Exhibit "A" is hereby granted the following variation from the standards of Ordinance No. 3100, being the Aurora Zoning Ordinance:
 
Section 5.13-3.1: Removal of enclosed parking.  The owner must add a flared extension to the north side of the driveway per AZO standards.
      
Section Three: That the plan(s), hereafter referred to as Exhibit "B", shall be attached hereto and incorporated herein by reference as if fully set forth.
 
Section Four: That this Ordinance shall be in full force and effect, and shall be controlling, upon its passage and approval.  
 
Section Five: That all Ordinances or part of Ordinances in conflict herewith are hereby repealed insofar as any conflict exists.  
 
Section Six: That any section, phrase or paragraph of this Ordinance that is construed to be invalid, void or unconstitutional shall not affect the remaining sections, phrases or paragraphs of this Ordinance which shall remain in full force and effect.
 
Section Seven: That the City Clerk of the City of Aurora is hereby authorized and directed to file with Kane County Recorder's Office a certified copy of this Ordinance, on the property legally described on Exhibit "A".
