SUBJECT:
A resolution authorizing the Mayor and City Clerk to execute an agreement between the State of Illinois Department of Transportation and the City of Aurora for improvements within the right-of-way along Illinois Route 31 from Indian Trail Road to Illinois Avenue (Agreement # JN-115-506) and the City Clerk to sign the associated Motor Fuel Tax Resolution.
 
PURPOSE:
To execute an 80/20 IDOT/City funding agreement for improvements to the median on North Lake Street (Route 31) from Illinois Ave. to Old Indian Trail Road.
 
BACKGROUND:
The State of Illinois and the City of Aurora are desirous of making improvements along this section of roadway including replacement of the median barrier curbs, street lighting, and landscaping. The State has offered to fund 80% not to exceed $475,000 for this work.
 
DISCUSSION:
The City will prepare the plans and specifications, receive bids and award the contract, and furnish the engineering inspection during the construction. By this agreement (Exhibit A) the City will front fund the cost and the State will reimburse the City for the construction and engineering costs of the improvement up to a maximum amount of $475,000.The total estimated cost for this improvement is $594,000 which includes engineering. The 2015 City Budget provides funding for this item in Account 203-4460-431.76-67 (Motor Fuel Tax Fund) and Account 340-4460-431.76-67 (Cap A)
 
IMPACT STATEMENT:
Roadway traffic will be reduced to one lane in each direction during construction.
 
RECOMMENDATIONS:
Please forward this resolution to the Finance Committee for their review and recommendation for approval.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
 
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
 
WHEREAS, there is a need for an agreement between the State of Illinois Department of Transportation and the City of Aurora for improvements within the right-of-way along Illinois Route 31 from Indian Trail Road to Illinois Avenue a copy of which agreement is attached hereto and incorporated herein as Exhibit 'A', and
 
WHEREAS, there is a need to appropriate Motor Fuel Tax funds for this agreement in the amount of $594,000, a copy of which resolution is attached hereto and incorporated herein as Exhibit 'B', and
 
WHEREAS, the 2015 City Budget provides funds for this item in account no. 203-4460-431.76-67 (Motor Fuel Tax Fund) and Account 340-4460-431.76-67 (Cap A).
 
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that the Mayor and City Clerk are hereby authorized to execute the Agreement as set forth in Exhibit 'A' and the City Clerk is hereby authorized to sign the Resolution for Improvement by Municipality Under the Illinois Highway Code as set forth in Exhibit 'B'.
