SUBJECT:

Seeking a Resolution to allow the Director of Purchasing to execute a Three-Year agreement between the City of Aurora and the Pipes and Drums of the Aurora Police, an Illinois Not for Profit Corporation.

 

PURPOSE:

The Aurora Pipes and Drums is an organization of current and former City of Aurora police officers who carry on the tradition of bagpipe music in the law enforcement profession for the City of Aurora.  The intent of the agreement is to allow for the City to provide financial support to the Pipes and Drums in return for the Pipes and Drums to perform at a minimum of 5 City special events annually. 

 

BACKGROUND:

Currently, the Pipes and Drums are paying for their own equipment and performance expenses.  The agreement would allow for the City to provide financial support for the Pipes and Drums and would allow for maintenance of instruments, travel, expenses, lessons, and uniforms. In return for the annual contribution, the Pipes and Drums would agree to provide performances at a minimum of 5 Special Events annually.  The events would be mutually agreed by the City and the Pipes and Drums.  Currently approximately 10 officers take part in the Pipes and Drums program.

 

DISCUSSION:

The agreement provides for an annual financial contribution from the City.  The agreement caps the annual contribution at $30,000 annually and further provides that the contribution is subject to the City's budget process.  It is possible that the contribution could fluctuate annually depending on the City's budget situation as well as the Pipes and Drums' annual needs.  The agreement contemplates a 2023 payment of $20,000.

 

The initial agreement is for a three-year term beginning 2023 and further it contains two one-year extensions for 2026 and 2027 as agreed by the Parties.

 

2023 payment will be made using account 215-3536-421.50-50.

 

 

IMPACT STATEMENT:

Without approval of the agreement, the Pipes and Drums may not be able to adequately maintain their instruments and equipment.  Further, citizens will be deprived of the performance of pipes and drums at parades and various other special events.  This tradition is will established in law enforcement.

 

 

RECOMMENDATIONS:

That the City Council approve the attached resolution authorizing the Director of Purchasing to to execute a Three-Year agreement with the Pipes and Drums of the Aurora Police, an Illinois not for Profit Corporation.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, The Pipes and Drums of the Aurora Police Department (Pipes and Drums) is an Illinois not for profit corporation consists of police officers who carry on the tradition of bagpipe music in the law enforcement profession for the citizens of Aurora; and

 

WHEREAS, Pipes and Drums members volunteer to participate in the organization and are responsible for the expenses they incur related thereto; and

 

WHEREAS, Pipes and Drums members provide valuable entertainment and continuity of the bagpipe music tradition for the citizens of Aurora; and

 

WHEREAS, the City holds various special events throughout the year; and

 

WHEREAS, the City would like to avail itself of the opportunity to have the Pipes and Drums perform at its special events; and

 

WHEREAS, the City would like to make a financial contribution in recognition of the Pipes and Drums performances; and

 

WHEREAS, the City intends that contributions it makes annually will go to support the efforts of the Pipes and Drums and to defray the operating expenses of the Pipes and Drums annually.

 

WHEREAS, the initial agreement is for a three-year term and further it contains two one-year extensions for 2026 and 2027 as agreed by the Parties.

 

WHEREAS, 2023 payment will be made using account 215-3536-421.50-50.

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: The City Council authorizes the Director of Purchasing to Execute a Three-Year agreement between the City of Aurora (City) and the Pipes and Drums of the Aurora Police, an Illinois Not for Profit Corporation (Pipes and Drums).  The Agreement is attached as Exhibit A.
