SUBJECT:

A Resolution Authorizing Execution of a Roadway Agreement for Duke Parkway extended to Route 59 in DuPage County, Aurora, Illinois  60502 (Duke Realty Limited Partnership - 17-00028 / WI33/4-16.224-AGR/RD - SP - Ward 10)

 

PURPOSE:

The Petitioner, Duke Realty Limited Partnership, is requesting approval of a Roadway Construction Agreement regarding the construction of the extension of Duke Parkway and its intersection with Route 59.   

 

BACKGROUND:

The Petition has secured a grant from IDOT’s Economic Development Program (EDP) in the amount of two million dollars ($2,000,000) toward the construction of the Intersection Improvements, with the City being designated the Sponsor Municipality.  The award of these funds is based on a new tenant of the business park, Amazon Company, which plans to create over 1,000 new jobs.   

 

DISCUSSION:

The Agreement details the provisions under which the City will be acting as the Local Agency/Sponsor Municipality to construct or cause to be constructed the Intersection Improvements.

 

There are several partnerships involved with the completion of this construction project and concurrently with this proposal, there is also being considered an Economic Development Program Agreement with the State of Illinois, a Local Agency/Company Agreement with Amazon.com, Inc., an Engineering Services Agreement with HR Green, Inc., and an Intergovernmental Agreement with the City of Warrenville.  

 

IMPACT STATEMENT:

The Planning and Zoning Division would anticipate that this project will increase the City’s overall tax base and viability by facilitating investment and development which will offset any incidental Department or staffing impacts.    

 

RECOMMENDATIONS:

Staff would recommend APPROVAL of the Resolution Authorizing Execution of a Roadway Agreement for Duke Parkway extended to Route 59.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, on November 16, 2016, Duke Realty Limited Partnership filed with the City of Aurora a request for the Requesting approval of a Roadway Construction Agreement regarding the Duke Parkway and Route 59 Intersection and related required documents as attached hereto as Exhibits "A"; and

 

WHEREAS, for reasons set forth in the Agreement the City and Duke Realty Limited Partnership wish to enter into said attached Agreement regarding Requesting approval of a Roadway Construction Agreement regarding the Duke Parkway and Route 59 Intersection; and

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that the Mayor and City Clerk be and are hereby authorized to execute the attached Agreement.

 

NOW THEREFORE, BE IT FURTHER RESOLVED that City Clerk be directed to file and keep on record said Agreement and a certified copy of this Resolution.
