SUBJECT:

A resolution to authorize the Mayor to renew the Intergovernmental Agreement with the Fox Metro Water Reclamation District to provide maintenance and operation services for the Combined Sewer Overflow Treatment Facility located at 400 N. Broadway, Aurora IL.

 

PURPOSE:

To authorize the Mayor and City Clerk to enter into a five year agreement with Fox Metro Water Reclamation District to assist in the maintenance of the CSO treatment facility located at 400 N. Broadway, Aurora IL.

 

BACKGROUND:

The City's CSO Waste Water Treatment Facility provides screening, primary treatment, disinfection and storage of CSO flows prior to discharge into the Fox River. The construction of the facility was required as part of an Illinois Pollution Control Board Order issued in 1988. The proper operation of this facility is essential in order to meet the City's National Pollutant Discharge Elimination System permit requirements. State Law requires that the Facility be operated by an Illinois licensed wastewater operator. The Fox Metro Water Reclamation District has the expertise and equipment to maintain and operate the facility. Fox Metro has satisfactorily operated the facility since completion of the plant in 1998.

 

DISCUSSION:

The 2024 budget contains $172,000 in the Water and Sewer Fund account 510-4063-511.32-24 for this work.

 

The duration of the proposed agreement is five years.

 

 

IMPACT STATEMENT:

This work is critical in order to comply with state and federal laws and to protect public health.

 

RECOMMENDATIONS:

I respectfully request that this resolution be considered for approval.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, the City of Aurora and Fox Metro Water Reclamation District have participated in the operation of the Combined Sewer Overflow Facility (CSO) at 400 N. Broadway since its construction in 1998; and

 

WHEREAS, per the Aurora's Illinois Environmental Protection Agency National Pollutant Discharge Elimination System permit the City is obligated to adequately maintain and operate its CSO facility; and

 

WHEREAS, the City has contracted with Fox Metro Water Reclamation District for the operation and maintenance of its CSO facility in the past, and said agreement is due for renewal; and

 

WHEREAS, the 2024 budget includes funding for this work in the Water and Sewer Fund account No. 510-4063-511.32-24;)

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: The Mayor and City Clerk are hereby authorized to enter into a five year agreement with the Fox Metro Water Reclamation District for the operation and maintenance of the Combined Sewer Overflow Facility located at 400 N. Broadway, Aurora Illinois which said agreement is attached.
