SUBJECT:

For a Development Agreement (DA) between the City of Aurora and M/I Homes of Chicago for the redevelopment of the property located at the southeast intersection of Ogden Ave and 75th Street into 185 single-family attached homes

 

 

PURPOSE:

The DA will facilitate the developer's plans to redevelop the area commonly known as the triangle at the southeast intersection of Ogden Ave and 75th Street into brand-new 185 single-family attached homes.

 

BACKGROUND:

The City of Aurora has seen substantial development and redevelopment in all corners of the city. This DA relates to a key property within the burgeoning Ward 8. The Subject Property was annexed into the City in 1998. In 2019, the City previously pass a resolution to redevelop the property with an assisted living facility, independent living facility, and other commercial uses, which has since expired.

 

The Developer, M/I Homes of Chicago, will build 185 single-family attached homes, known as the Kingsley Road Subdivision.

 

DISCUSSION:

The Property is currently vacant land and zoned R-5 (C) Multi-family Dwelling District, R-5A(C) Multi-family Dwelling District, B-2(C) Business District, General Retail, and OS-1 Open Space, Parks and Recreation District with a Conditional Use Planned Development. The Kingsley Road Subdivision will be rezoned to Property to R-4A(C) and OS-1(C) with a Conditional Use for a Planned Development to facilitate development of the Subject Property

 

On May 20, 2026, the City published notice of, and held, a public hearing before the City of Aurora Planning and Zoning Commission, regarding recommendation of a conditional use planned development, plan description, rezoning of the Subject Property, and preliminary plan and plat for the Subject Property

 

The Developer will comply with all applicable ordinances and laws of the State of Illinois regarding all petitions for zoning and development approvals relating to the Subject Property.

 

 

IMPACT STATEMENT:

The approval of this agreement will increase the tax base and provide for future development of the surrounding areas.

 

RECOMMENDATIONS:

Staff recommends approval.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS,

M/I Homes of Chicago has approached the City with a proposal for the development of located at the southeast intersection of Ogden Ave and 75th Street for the development 185 single-family attached homes; and

 

WHEREAS, Developer will acquired the property and intends to redevelop the Property as a residential  space in accordance with the terms and provisions hereof (the "Project"); and;

 

WHEREAS, the City finds that as a direct result of the Project, the City will benefit through the creation of new residential units that will fill a need in areas adjacent; and

 

WHEREAS, the project will strengthen the residential environment within the City and the enhancement of its tax base, and that the Project will serve as a catalyst for the repopulation of areas adjacent and invigorate the neighborhood; )

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: A Resolution authorizing a Development Agreement (DA) between the City of Aurora and M/I Homes of Chicago

 

BE IT RESOLVED, that the Mayor is authorized to execute an Agreement that substantially and materially conforms to the provisions of the Agreement set forth in the exhibits on behalf of the City for redevelopment of the Property as a residential development with 185 single-family attached homes; and further

 

BE IT RESOLVED, that the several City Officers and employees designated in the Agreement are authorized to perform the function and duties set forth in the Agreement; and further

 

BE IT RESOLVED, that the Mayor is authorized to execute such documents or agreements between the City and the Developer which are related to and subordinate to the Agreement so long as (1) such additional documents or agreements are consistent with and do not conflict with the provisions of the Agreement authorized by this Resolution (2) are necessary to carry into effect the purposes of the Agreement, and (3) do not create any additional liabilities upon the City.
