SUBJECT:
Request for a Resolution approving an extension of contract with Allied Waste Services of North America, LLC, d/b/a Republic Services of Aurora for refuse, recyclables, and yard waste collection services for the City of Aurora.  
 
PURPOSE:
To obtain City Council approval to extend the contract with Allied Waste Services of North America, LLC, d/b/a/ Republic Services of Aurora for a one (1) year renewal.  The same rates and terms as set forth in the Agreement shall apply unless otherwise modified by mutual agreement of the Parties.
 
BACKGROUND:
The current two (2) year contract with Allied Waste Services expires on June 30, 2014.  After careful consideration and following several discussions with Allied Waste that involved various options for service with rates, it was determined by staff that it would be of best interest to extend the contract with Allied Waste Services of North America, LLC, d//b/a Republic Services of Aurora, in accordance with Section 4 of the contract.  The extension and rates would be for a one (1) year period as referred to in "Exhibit A" which is attached.  Pursuant to the original contract language, the agreement may be modified or extended by mutual agreement of the parties.
 
DISCUSSION:
The funds for refuse collection are budgeted in 208-1727-424-45.62 to cover the costs.  This extension allows the staff to continue negotiations for services that are most beneficial to the citizens of Aurora which includes the highest customer service available, the most economical with cost effectiveness and will meet sustainable goals for the refuse collection in Aurora.
 
IMPACT STATEMENT:
This extension will allow the refuse collection to continue without interruption of services provided to the city of Aurora.
 
RECOMMENDATIONS:
That the City Council adopt the resolution that would extend the contract with Allied Waste Services of North America, LLC. d/b/a Republic Services of Aurora.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
 
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
 
WHEREAS, the current Contract for Refuse, Recyclables, and Yard Waste Collection Services between the City of Aurora and Allied Waste Services of North America LLC, d/b/a Republic Services of Aurora, will expire on June 30, 2014; and
 
WHEREAS, after consideration of various options and rates presented, the City has determined that it is in the best interest of the citizens of the City of Aurora to extend the contract with Allied Waste Services of North America, LLC, d/b/a Republic Services of Aurora, in substantial accordance with Section 4 of the Contract, for a one year period, from July 1, 2014 until June 30, 2015 for the services and at the rates that are contained in the Contract as modified by the extension document attached hereto as Exhibit "A" and unless otherwise amended by the parties as provided in Section 39 of the Contract; and
 
WHEREAS, there are funds in the budget at item 208-4450-424-45.62 to cover the costs hereof.
 
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, that the Contract extension terms, and the services and rates set forth therein, is hereby approved and incorporated into the existing Contract between the City of Aurora and Allied Waste Services of North America, LLC, d/b/a Republic Services of Aurora, pursuant to the contract extension document attached hereto and incorporated as if fully set forth herein.
