A resolution authorizing the Mayor to Execute the Local Agency Agreement for federal participation with the State of Illinois in the amount not to exceed $505,382.00 and Phase 2 Preliminary Engineering Agreement with HR Green, Inc. and the City Clerk to sign the appropriation of REBUILD Illinois Bond Funds for Montgomery Road and Hill Avenue Intersection Improvements, MFT #19-00329-00-CH in an amount of $505,382.00.
PURPOSE:
To execute the Local Agency Agreement to reserve sufficient funds to cover the upfront cost of Phase 2 engineering by resolution, to approve Phase 2 design engineering services agreement with HR Green, Inc. and to Appropriate REBUILD Illinois Bond Funds by IDOT resolution.
BACKGROUND:
The intersection of Montgomery Road at Hill Avenue falls under various jurisdictions - north and east legs are under the jurisdiction of City of Aurora, west leg comes under Kane County and the south leg is a State route. Kane County Department of Transportation has completed a Phase 1 study for Montgomery Road corridor that extends the subject project limits (i.e. Briarcliff Road to South Farnsworth Avenue) and has received IDOT's design approval. City took the lead to improve the intersection of Montgomery Road and Hill Avenue and applied for Congestion Mitigation and Air Quality Improvement Program (CMAQ) grant in early 2019 and was approved in late 2019.
City has requested Kane County Division of Transportation and State for their financial participation in phase 3, the costs of which are to be finalized in Phase 2.
DISCUSSION:
The improvements at the intersection involves modernizing traffic signals, reconstructing and widening the roadway to include additional channelization on Montgomery Road, adding one through lane in each direction on Hill Avenue, constructing bike path, sidewalk, ADA ramps, detectable warning signs, enhanced crosswalks and other pertinent work.
The project limits on the east leg of Montgomery Road will be extended by approximately 1,200 feet to connect to the improved 3-lane section of Montgomery Road for better traffic flow.
A Quality Based Selection (QBS) process was followed to select the Phase 2 engineering consultant. A QBS proposal request was posted on November 4, 2019 and a total of 7 proposals were received. HR Green, Inc. was selected to conduct the Phase 2 design engineering by City staff. QBS ranking attached.
The total construction cost of this project is estimated at $4,418,996.00. The total CMAQ federal funds allocated to this project is up to $4,991,589.00 (Construction, Right of Way, Phase 2 and 3 engineering). CMAQ grant is an 80/20 split program and is a reimbursable program.
City would have to execute the Local Agency Agreement by setting aside the upfront cost for Phase 2 engineering in the amount of $505,382.00, agreement is attached hereto.
City would have to execute the Phase 2 Preliminary Engineering Agreement with HR Green, Inc. to start the Phase 2 process, agreement is attached hereto.
IDOT requires a Resolution to Appropriate the REBUILD Illinois Bond Funds prior to their expenditure for approved projects. The resolution for improvement - BLR 09110 appropriating REBUILD Illinois Bond Funds in the amount of $505,382.00 is attached.
The project was budgeted to use Motor Fuel Tax (MFT) funds and a budget amendment will be required switching the funding source on this project from MFT to the new REBUILD Illinois Bond Fund. The REBUILD Illinois Bond Fund is a grant program using proceeds from general obligation (transportation, series A) bonds authorized in the REBUILD Illinois capital program to provide Local Agencies with the funds for transportation improvement projects. At this time IDOT intends to award and disburse REBUILD Illinois grants twice each year over a period of 3 years. The City has received 2 payments in 2020 and the remainder are anticipated to be received in 2021 and 2022. The City is estimated to receive $13,042,322.82 in total over this 3 year period. The funds can only be used on bridge and major highway projects that provide an average useful life of greater than or equal to 13 years.
The 2020 Fiscal Year budget provides funds through the following account (subject to the amendment):
GB121 Montgomery and Hill Intersection Improvements 202-4460-431-79-99 $200,000.00
City's future fiscal year of 2021 currently shows a forecast of $305,400.00 for the above project account and shall be budgeted that way.

RECOMMENDATIONS:
Staff recommends execution and approval of the Local Agency Agreement, Phase 2 Preliminary Engineering Agreement with HR Green, Inc. and appropriate REBUILD Illinois Bond Funds in the amount of $505,382.00 for section no. 19-00329-00-CH.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, City intends to improve the intersection of Montgomery Road and Hill Avenue to enhance the roadway capacity & operational efficiency and improve safety for all roadway users including pedestrians and bicyclists. The proposed improvements shall include modernizing traffic signals, widening and reconstructing the roadway to include exclusive right-turn lanes on Montgomery Road, addition of one through lane in each direction on Hill Avenue, extending the left-turn bays for additional storage, constructing bike path, sidewalk, ADA ramps, detectable warning signs, enhanced crosswalks, adding left turn lane on Montgomery Road at N Farnsworth Avenue while extending the improvements approximately 1,200 ft. east to connect to the improved 3-lane section of Montgomery Road and other pertinent work as needed. The project has a State Job No: D-91-386-20; Project No: ZHIL (299); and MFT Section No: 19-00329-00-CH.
WHEREAS, Montgomery and Hill Avenue Intersection Improvement project has been awarded Congestion Mitigation and Air Quality Improvement Program (CMAQ) grant funds, a federal funding in the amount not to exceed $4,991,589.00 (Phase 2 and 3 Engineering, ROW & Construction)
WHEREAS, the use of federal funds requires the City to execute the Local Agency Agreement with State of Illinois (IDOT) by way of appropriating the upfront cost for Phase 2 Preliminary Engineering in the amount of $505,382.00 (about $371,196.00 of the phase 2 amount is expected to be reimbursed through the CMAQ grant at a later stage) of which the agreement is attached
WHEREAS, there is a need to execute Phase 2 Preliminary Engineering with HR Green, Inc. in order to continue the project of which the agreement is attached
WHEREAS, there is a need to appropriate REBUILD Illinois Bond Funds (MFT # 19-00329-00-CH) funds for this project in the amount of $505,382.00 a copy of which resolution is attached for approval.
WHEREAS, the City of Aurora fiscal year 2020 Budget provides funds by way of the following account:

City's future fiscal year 2021 forecasts $305,400.00 under the project account and will suffice for the remaining funds.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that the City of Aurora authorizes the Mayor to execute both the Local Public Agency Agreement for Federal Participation with the State of Illinois (LPAA attached) and Phase 2 Preliminary Engineering Agreement with HR Green, Inc. (Phase 2 agreement attached) and the City Clerk to sign the REBUILD Illinois Bond Funds Resolution with Section Number 19-00329-00-CH, in the amount of $505,382.00 (IDOT resolution attached).
BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any other such documents related to advancement and completion of the said project.
