A resolution authorizing the Director of Purchasing to Process a Change Order to the Agreement with Performance Construction & Engineering, LLC for the S. Broadway Ave Sewer Separation - Hazel Ave to North Ave Contract in the amount of $90,000.00.
PURPOSE:
Authorize additional funds for the completion of the sewer separation project begun in 2025 which is to be completed in spring of 2026.
BACKGROUND:
New storm sewers were installed to remove surface drainage flows from the combined sewer system in 2025. Approximately 80 of the 100 lead water services were also replaced in 2025. The final 20 lead services were replaced in March 2026 and final restoration will occur in spring of 2026. A location map is attached to show the limits of the project. This project will help satisfy the requirements associated with the City's Long Term Control Plan and the City's Illinois Environmental Protection Agency Combined Sewer System Overflow.
The original bid did have a 7.5% contingency which is expected to be exhausted during spring 2026 restoration of the project. In 2025, there were several revisions to the project that resulted in cost increases. The City was required to transport and dispose of spoils at a landfill that were not eligible for disposal at a Clean Construction Demolition Debris (CCDD) facility. Also, the project was originally bid before the IDOT review process was completed. Several additional storm structures, pipe upsizing and alignment changes resulted in additional costs. Lastly, IDOT was always planning to resurface this section of Illinois Route 25 following the completion of the utility work which also included the replacement of the concrete curb and gutter. However, the City was unaware that despite the plan to raise the grade of the curb and gutter, IDOT had no intention of replacing the adjacent driveway aprons. In the City's experience with previous roadway modification projects that involved the replacement and raising of the curb and gutter, it has always been critical to replace the driveway aprons. As a result, the City is committed to replacing those aprons which will push the cost of the project over the previously approved contingency amount.
During the initial approval of this project, it was planned for this project to be fully funded by the City. Prior to construction, the City requested partial reimbursement from IDOT to offset the cost to drain the areas in IDOT Right-of-way. As a result, IDOT agreed to reimburse the City $725,736.00 which was approved with an Intergovernmental Agreement at the January 27, 2026 City Council meeting as resolution R26-016. The formal request for reimbursement will be made to IDOT following the completion of construction.
DISCUSSION:
The project was originally bid with bids opened on February 12, 2025 with Performance Construction & Engineering, LLC providing the low bid. The contract was then presented and approved at the March 11, 2025 City Council meeting on as resolution R25-077. Additional funds are proposed to come from account 281-1856-512-73-09 (B031, LTCP Improvements - Sewer Separation) which has a budget of $2,800,000.00 for 2026. The proposed 2026 projects to be completed from the funds in this account are to be bid soon and should still be able to be completed after the approval of the change order.
IMPACT STATEMENT:
Adopting this resolution will provide a better long-term solution for the residents along this corridor.
RECOMMENDATIONS:
I request the proposed resolution be adopted.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, on February 12, 2025 the City of Aurora received and opened proposals submitted by four qualified contractors for the installation of storm sewers and the full replacement of disturbed lead water service lines along this corridor; and
WHEREAS, a 2025 contract value of $ 3,338,777.00 was awarded by City Council (R25-077) but is likely to be exceeded in April 2025; and
WHEREAS, a change order in the amount of $90,000.00 is requested from account 281-1856-512-73-09 (B031) to cover the requested change order; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: the City of Aurora's Director of Purchasing is hereby authorized to Process a Change Order to the Agreement with Performance Construction & Engineering, LLC for the S. Broadway Ave Sewer Separation - Hazel Ave to North Ave Contract in the amount of $90,000.00.
