SUBJECT:
To request approval of an amended Intergovernmental Parking Agreement ("IGA) between the City of Aurora and Waubonsee Community College ("WCC") in order to continue discussions on a permanent parking solution for WCC's students.
 
PURPOSE:
Prior to completion of the WCC new downtown campus, efforts were focused on collectively working on both a temporary and permanent parking solution for its students and faculty. While temporary solutions have been implemented, the IGA gave both parties four years to develop a permanent parking solution. A permanent solution has yet to fully develop so it is being requested that the IGA continue for one year, with up to three additional annual extensions upon mutual request by both parties. Should the amended agreement be approved, WCC will pay to the City a sum of $100,000, which constituted its last payment on a temporary parking solution pursuant to the IGA.
 
BACKGROUND:
The Current Intergovernmental Parking Agreement R11-127, was approved by City Council May 24, 2011. The agreement contained both short term parking solutions, and also provided for cooperation between both parties to develop a permanent parking solution. The City, in its efforts to provide temporary parking for WCC, has provided 105 parking spaces in the Tivoli Parking Deck for faculty and staff. Also, the City added spaces to its current public parking lot W on north River Street, bringing the total available parking in Lot W and Y to 504 spaces. This was constructed in part with a $400,000 contribution from WCC, as part of a $500,000 total contribution for this temporary solution. Also, Lot A, located immediately west of these lots, provide an additional 192 parking spaces. Close to 700 spaces are available in these River Street lots alone, and 360 were to be made available to WCC. This was more than satisfactory from the supply side of parking needs for WCC.
 
DISCUSSION:
Both parties were to diligently work on a permanent parking solution, due to the fact that the parking lots on north River Street would someday be developed for either commercial or residential purposes. The construction of a new parking deck nearer the campus was part of the ongoing discussions, as well as increased use of the Tivoli Deck should Hollywood Casino, as has been indicated in the past, elects to construct a deck closer to their facility. With these current discussions ongoing, and the likelihood that Lots W and Y would be available for the near future, extending the deadline for a permanent solution is feasible. In the meantime, both the City and WCC will work cooperatively not only on a permanent solution, but also engage in discussions on current parking habits of students so as to best utilize public parking lots and on-street parking for the benefit of all downtown patrons.
 
 
IMPACT STATEMENT:
There will be no additional impacts on current services other than those contained in the IGA.
 
RECOMMENDATIONS:
It is recommended that the resolution approving an extension to the existing IGA between the City of Aurora and Waubonsee Community College be approved.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
 
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
 
WHEREAS, the City of Aurora ("City") and Waubonsee Community College ("WCC")  are each legal entities organized and existing under the laws of the State of Illinois, having among their powers the authority to contract with one another to perform the undertaking described herein; and
WHEREAS, the City and WCC entered into an Intergovernmental Parking Agreement (IGA) pursuant to Resolution R11-127, passed and approved by the City on May 24, 2011, which provided for both temporary parking measures and an agreement to look at a permanent parking solution; and
 
WHEREAS, the City and WCC both seek to amend the Intergovernmental Parking Agreement for the purpose of extending the time frame in which to present for consideration a permanent parking solution; and
 
WHEREAS, the City Council of the City of Aurora has determined that it is in the best interest of the City and its residents to enter into this amended IGA; and
 
WHEREAS, the City Council has reviewed and approved the attached Amended Intergovernmental Parking Agreement, including the payment by WCC of an additional $100,000 to the City of Aurora as final payment toward assistance with the temporary parking solution.)
 
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: That the Amended Intergovernmental Parking Agreement in the form of Exhibit "A" attached hereto and included herein by reference as if fully set forth, between the City and WCC be approved, and the Mayor of the City of Aurora is hereby authorized and directed to execute the Amended Intergovernmental Parking Agreement on behalf of the City.
