SUBJECT:

To consider a development agreement between the City of Aurora and Metro 59, LLC for a partial building permit fee reduction for Metro 59 apartments located on Station Boulevard.

 

PURPOSE:

Metro 59, LLC has submitted for building permit review and approval by the City's Division of Building and Permits. Metro 59, LLC desires to pick up permits in mid-August and begin construction on what is an $80,000,000 + multi-family community consisting of 460 units in 7 buildings, which also includes a separate clubhouse building.  This partial reduction is to help cover some extraordinary costs associated with the construction of Station Boulevard itself.

 

BACKGROUND:

This complex has been in the planning stage for several years. It has changed ownership a few years ago, and as the renderings show, Metro 59, LLC is planning a luxury, urban style architecture complex south of the Route 59 train station.  All buildings will include first floor indoor parking, all in accordance to our current standards. Also, Metro 59, LLC assisted with the construction of Station Boulevard, and has to date contributed $2,000,000 + toward the roadway, with only the construction of the signalized intersection remaining ($200,000).  It is planned that the west side buildings, including the clubhouse, will be constructed first.

 

DISCUSSION:

The reduced amount being requested is $109,054. Permit fees associated with each building ranges from $54,527 to $104,706, depending on the size of each building. This is only the Building Permit Fee and does not include Park District Fees, School Fees, water connection fees, fire impact fees, etc.  Most individual building fee totals are $240,000 each, with the largest building having $472,000 in total fees. Again, it is only being requested that the reduced amount be to cover the extraordinary costs associated with the completed roadway, and future signal. No payments are being recommended to Metro 59, LLC, it is recommended that the building permit fee line item be reduced by 50% prior to them being picked up.

 

IMPACT STATEMENT:

The impact on the general public would be minimal. School, park, fire impact and water fees will be continued to be paid by developer as permits are picked up, and completion of improvements to Station Boulevard will assist in making the best use of this roadway for both residents and commuters, as was originally planned.  Also, it is anticipated that the Metro 59 development will be the most expensive construction project of its type in Du Page County.

 

RECOMMENDATIONS:

It is recommended that the development agreement for the reduction in building permit fees for Metro 59 in the amount of $109,054 be approved with the following conditions:

 

(A)                     Developer agrees and covenants the Project will consist of the construction of 460 residential units in seven (7) buildings, including a clubhouse, and will provide amenities as depicted on the building plans submitted to the Division of Building and Permits and will be amenitized in accordance with the attached marketing brochure entitled “Metro 59 Aurora, Illinois” attached hereto as Exhibit A

(B)                     Developer agrees that the building permit fee reduction will be for the benefit of Metro 59, LLC only, as developer of the Metro 59 project.

(C)                     Developer agrees to pick up and pay for the permits for buildings 1, 2, 3, 5 and clubhouse no later than September 30, 2015.

(D)                     Developer agrees to contribute funds necessary to complete Developers share of the signalization work at Station Boulevard and Meridian Lakes Drive.

(E)                     Pursuant to Section 7.11-3.2.A.ii of the Aurora Zoning Ordinance a Property Management Agreement is required.  Developer agrees, that all Homeowners Association obligations or requirements set forth in any prior City Council approval shall be incorporated into said Property Management Agreement. 

(F)                      Developer agrees, to grant the City, at no cost, a temporary construction easement in and around building 7 for the purposes of the City’s Station Boulevard extension into Route 59 Parking Lot Modifications Project.  The temporary construction easement shall be granted until such time as the City’s project is completed or a building permit for building 7 is picked up and paid for.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, Metro 59, LLC ("Developer") has submitted for building permit review and approval to begin construction on what will be a luxury mid-rise multi-family community consisting of 460 units in 7 buildings, which also includes a separate clubhouse building; and

 

WHEREAS, Developer also assisted with the construction of Station Boulevard, and has to date contributed $2,000,000 + toward the roadway, with only the construction of the signalized intersection remaining ($200,000); and

 

WHEREAS, Developer has requested a partial building permit fee reduction in the amount of $109,054 to offset extraordinary costs associated with the construction of the roadway, with said request being a reduction by 50% the permit fee line item for each permit issued, up to said maximum amount; and

 

WHEREAS, it is in the best interests of the City and its residents that said development agreement be approved so that permits can be picked and paid, and construction can commence.

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: That the Development Agreement attached hereto and made a part thereof as Exhibit A be approved
