SUBJECT:

A Resolution Approving a Revision to the Final Plat for Lots 1, 4 and 6 of West Aurora Plaza Resubdivision Subdivision, located at 1901-1989 West Galena Boulevard and establishing Lot 10-15 of West Aurora Plaza Resubdivision Subdivision, No. 2 (Windmill Hill LLC - 24-0704/ AU19/2-24.319 - Fsd - EF - Ward 5)  

 

PURPOSE:

The Petitioner Windmill Hill LLC is requesting approval of a Final Plat Revision subdividing a portion of West Aurora Plaza Resubdivion located at 1901-1989 West Galena Boulevard and establishing Lot 9 thru Lot 16 of West Aurora Plaza Resubdivision No 2. which includes a subdivision of approximately 19 acres into eight new lots.   

 

BACKGROUND:

The Subject property is currently Retail with B-2(C) General Retail with a conditional use zoning which is part of the West Aurora Plaza Conditional Use Planned Development. The Petitioner is requesting approval of a Final Plat Revision subdividing the property located at 1901-1989 West Galena Boulevard and establishing Lot 9 thru Lot 16 of West Aurora Plaza Resubdivision No 2.

 

West Aurora Plaza Subdivision Unit One was established in 1959. West Aurroa Plaza Subdivision Unit Two was established in 1963. The area was resubdivided in 2018 to become the West Aurora Plaza Resubdivision. The 2018 resubdivision was done to create 5 lots that corresponded to the current buildings and parking areas and created three new out lots as well as create a new plan description for the area. The new subdivision is taking lots 1,4, and 6 from the first resubdivision and creating 8 new lots out of the 3 old lots. This resubdivision is to connect parking in the lots with the buildings in the lots. 

 

DISCUSSION:

Staff has reviewed the Final Plat Resolution petition and have sent comments back to the petitioner on those submittals.  The petitioner has made the requested revisions to these documents and they now meet the applicable codes and ordinances.

This plat is resubdividing three lots to create eight lots. This will help facilitate the sale of existing parking lots to various retail shops and existing lots. This project will logically pair the parking fields with their associated buildings. A cross-access agreement will remain across the shopping center.  

 

POLICIES AND GUIDELINES:

10.0 To provide for the orderly, balanced and efficient growth and redevelopment of the City through the positive integration of land use patterns, functions, and circulation systems. To protect and enhance those assets and values that establishes the desirable quality and general livability of the City. To promote the City’s position as a regional center.

12.1 (9) To guide development and redevelopment into energy efficient land use patters.

14.1 (4) To encourage quality site design throughout the City.

32.0 To enhance the positive and minimize the negative impact and relationships that the location, design and appearance of commercial activities have on traffic patterns and on the stability and vitality of surrounding neighborhoods, other commercial centers, and the City as a whole.  

 

RECOMMENDATIONS:

The Planning and Zoning Commission recommended APPROVAL of the Resolution approving a Revision to the Final Plat for Lots 1, 4 and 6 of West Aurora Plaza Resubdivision Subdivision, located at 1901-1989 West Galena Boulevard and establishing Lot 10-15 of West Aurora Plaza Resubdivision Subdivision, No. 2.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, by petition dated August 23, 2024, Windmill Hill LLC filed with the City of Aurora a petition requesting approval of a Final Plat Revision subdividing the property located at 1901-1989 West Galena Boulevard and establishing Lot 9 thru Lot 16 of West Aurora Plaza Resubdivision No 2. and related required documents as attached hereto as Exhibits "A"; and

 

WHEREAS, the Planning and Zoning Commission conducted a hearing on October 2, 2024, reviewed the petition and recommended APPROVAL of said petition; and

 

WHEREAS, on October 9, 2024, the Building, Zoning and Economic Development Committee of the Aurora City Council reviewed said Final Plat and the before mentioned recommendations and recommended APPROVAL of said petition; and 

 

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Aurora, Illinois, finds as facts all of the preamble recitals of this Resolution and hereby grants APPROVAL of said Final Plat.
