SUBJECT:

A resolution authorizing the execution of a Redevelopment Agreement between the City of Aurora and the Owner of the property at 1128 East New York Street (Ward 7).

 

PURPOSE:

To expedite demolition of the existing building on 1128 East New York Street.

 

BACKGROUND:

The Owner of 1128 East New York Street is also the owner of the gas station site immediately to the west (1116 East New York Street).  The Owner acquired 1128 East New York Street with the intent to demolish the site and incorporate the redevelopment of 1128 East New York Street with the planned improvements at 1116 East New York Street.  During the process of securing a demolition permit, the Owner realized that meeting the City's requirements for a demolition permit would be cost prohibitive at this time.

 

DISCUSSION:

The existing building at 1128 East New York Street is an eyesore (see Exhibit B).  The Owner is willing to demolish the building immediately, as long as the City is willing to defer some of the demolition permit requirements until the site can be redeveloped with the planned improvements to the adjacent gas station site at 1116 East New York Street.  The permit requirements that would be deferred include: removal of the curb cut, removal of the asphalt surface covering most of the site, and disconnection of the water and sewer service lines at their connection points to the public mains in New York Street.  Permit fees will not be waived and no additional building permits will be granted unless such permits include the required demolition actions noted above.

 

IMPACT STATEMENT:

Demolishing the building without removing the curb cut can encourage fly dumping.  Old service lines are prone to leaks, so it is standard practice to disconnect water and sewer services at the public main when they no longer serve a useful purpose.  However, the Redevelopment Agreement mitigates the City's risk by giving the City the right to cure nuisances caused by the deferred demolition tasks and lien the property for the cost, if the nuisances are not cured promptly by the Owner.

 

RECOMMENDATIONS:

Staff recommends authorizing the execution of the Redevelopment Agreement.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, the Owner of the property at 1128 East New York Street is willing to demolish the existing building at the site immediately;

 

WHEREAS, the City is willing to defer other demolition tasks until the property can be redeveloped, considering the City's interest in the demolition of the building and the protections provided by the Redevelopment Agreement.

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: said Council authorizes the execution of the Redevelopment Agreement between the City of Aurora and the Owner of the property at 1128 East New York Street as set forth in Exhibit A.
