A Building, Zoning and Economic Development Committee Resolution Approving a Final Plan on Lot 3 of Citizens First National Bank Business Park Subdivision located at 1521 Ogden Avenue for a Retail/Office Use (Param Vijay - 19-0825 / OS01/1-19.054-Fpn - JM - Ward 9)
PURPOSE:
The Petitioner Param Vijay is requesting approval of a Final Plan for Lot 3 of Citizens First National Bank Business Park Subdivision located at 1521 Ogden Avenue for a mixture of Business and Professional, Office (2400), Retail Sales or Service (2100), and Restaurant with a drive-through facility (2530) uses which includes two buildings in two phases of approximately 35,000 sf. in total size.
BACKGROUND:
The Subject Property is currently Vacant Land with B-2(S) General Retail District with a Special Use zoning, which is part of the Summerlin Special Use Planned Development from 1995. Additional information on the legislative history of the property can be found in the attached Property Information Sheet.
The Petitioner is Requesting approval of a Final Plan for Lot 3 of Citizens First National Bank Business Park Subdivision located at 1521 Ogden Avenue for a mixture of Business and Professional, Office (2400), Retail Sales or Service (2100), and Restaurant with a drive-through facility (2530) uses. The details of the request include an initial phase one, one story building of 9,914 sf. with a mix of office and retail including a drive-thru. The owner's wife will occupy approximately 3,275 sf. of this space as a dental office. Phase two will include a two story building of approximately 25,336 sf. consisting of first floor retail and second floor office space. Parking will also be developed in two phases to meet the requirements of each building. The 30 foot setback to the south will be maintained which consists of an existing landscaped berm which will be enhanced with additional landscaping to form a buffer to the existing Summerlin Subdivision to the south. Cross access drive along Ogden Avenue will interconnect to the rest of the commercial development to the east (daycare and bank).
DISCUSSION:
Staff has reviewed the Final Plan petition and have sent comments back to the petitioner on those submittals. The petitioner has made the requested revisions to these documents and they now meet the applicable codes and ordinances, with the exception of the items reflected in the conditions listed in the Staff Recommendation below. These consist of some Engineering details that are still being reviewed.
POLICIES AND GUIDELINES:
11.1 (5) To guide and promote development to areas where public utilities, public roads and municipal services are either available or planned.
31.1 (5) To promote the vitality of existing commercial centers within the commercial hierarchy.
RECOMMENDATIONS:
Planning Commission would recommend CONDITIONAL APPROVAL of the A Building, Zoning and Economic Development Committee Resolution Approving a Final Plan on Lot 3 of Citizens First National Bank Business Park Subdivision located at 1521 Ogden Avenue for a Retail/Office Use, with the following conditions:
1) That all of the review comments per the Engineering Department be address prior to approval of the Final Engineering Plans.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, by petition dated September 6, 2019, Param Vijay filed with the City of Aurora a petition requesting approval of a Final Plan for Lot 3 of Citizens First National Bank Business Park Subdivision located at 1521 Ogden Avenue for a mixture of Business and Professional Office (2400), Retail Sales or Service (2100), and Restaurant with a drive-through facility (2530) uses and related required documents as attached hereto as Exhibits "A-1" through Exhibit “A-3”; and
WHEREAS, after referral of said petition from the Aurora City Council, and after due notice and publication of said notice, the Aurora Planning Commission on December 11, 2019, reviewed the petition and recommended CONDITIONAL APPROVAL of said petition; and
WHEREAS, on December 19, 2019, the Building, Zoning and Economic Development Committee of the Aurora City Council reviewed said Final Plan and the before mentioned recommendations and recommended CONDITIONAL APPROVAL of said petition; and
WHEREAS, the decision of the Building, Zoning and Economic Development Committee with respect to a final plan is subject to appeal to the City Council in the manner set forth in the City of Aurora Zoning Ordinance; and
WHEREAS, no person authorized under City of Aurora Zoning Ordinance to appeal such decision having done so in the manner set forth in the Ordinance, the Decision of the Building, Zoning and Economic Development Committee constitutes final action on the proposed final plan; and
NOW, THEREFORE, BE IT RESOLVED that the Building, Zoning and Economic Development Committee of the City of Aurora, Illinois, finds as facts all of the preamble recitals of this Resolution and hereby grants CONDITIONAL APPROVAL of said Final Plan with the following conditions:
1) That all of the review comments per the Engineering Department be address prior to approval of the Final Engineering Plans.
BE IT FURTHER RESOLVED that the Building, Zoning and Economic Development Committee of the City of Aurora hereby adopts the Final Plan and related required documents, as attached hereto as Exhibit "A-1" Final Plan, Exhibit “A-2” Landscape Plan, and Exhibit “A-3” Building and Signage Elevations, along with any easement dedications or vacations deemed necessary by the Aurora City Engineer
