A Resolution Approving the Final Plan Revision on Lot 2 of Naftali Subdivision for a Commercial Use located at 1260 Orchard Road, Aurora, Illinois 60506 (The Wendy's Company, Inc. - 14-00610 / SG12/4-14.210-Fpn - ES - Ward 5)    
 
PURPOSE:
The Petitioner, The Wendy's Company, Inc., has submitted a Final Plan Revision to add an outdoor patio to the existing restaurant located at 1260 Orchard Road.   
 
BACKGROUND:
This restaurant is located within the Orchard Road commercial corridor on the far west side of Aurora.  It is within the shopping center anchored by the Home Depot.  Across the street is the Exel (Kraft) warehouse/distribution facility.  
 
DISCUSSION:
Staff has reviewed the Final Plan petition, submitted by the petitioner and have sent comments back to them on those submittals.  The petitioner has made all the requested changes to these documents and they now meet all of the applicable codes and ordinances.  This is an upgrade to an existing Wendy's to add a small outdoor seating area to a previously unused space.  New landscaping and handicap accessibility will also be upgraded.  A decorative metal fence will surround the patio area.  
 
IMPACT STATEMENT:
The Planning and Zoning Division would anticipate that this project will increase the City's overall tax base and viability by facilitating investment and development.   
 
RECOMMENDATIONS:
The Planning Commission recommends APPROVAL of the Resolution Approving the Final Plan Revision on Lot 2 of Naftali Subdivision for a Commercial Use located at 1260 Orchard Road, Aurora, Illinois 60506.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
 
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
 
WHEREAS by petition dated July 22, 2014, The Wendy's Company, Inc. filed with the City of Aurora requesting a Final Plan Revision for Lot 2 of the Naftali Subdivision as described on Exhibit "A" attached hereto; and
 
WHEREAS, on August 6, 2014, the Aurora Planning Commission reviewed said Final Plan and recommended APPROVAL of said petition; and
 
WHEREAS, on August 14, 2014, the Planning and Development Committee of the Aurora City Council reviewed said Final Plan and before mentioned recommendations and recommended APPROVAL of said petition; and   
 
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Aurora, Illinois, finds as facts all of the preamble recitals of this Resolution and hereby grants APPROVAL of said Final Plan;
 
BE IT FURTHER RESOLVED that the City Council of the City of Aurora hereby adopts the Final Plan as described on Exhibit "A" along with any dedications deemed necessary by the Aurora City Engineer.
