SUBJECT:
Resolution Authorizing the Execution of a Intergovernmental Agreement between the City of Aurora and the Fox Valley Park District for Police Services at Phillips Park and all other City Parks.  Approval is needed by February 28th, 2014.
 
PURPOSE:
To obtain City Council approval for police services for the Divisions of Parks & Recreation through February 28, 2017.  The dedicated security that this has provided has helped create the family-oriented environment that Phillips Park is known for today.
 
BACKGROUND:
The City of Aurora has hired the Fox Valley Park District to provide police services at Phillips Park since 2002.  The pricing for the current contract which will expire on February 28, 2014 is $90,800.00 annually.  The agreement has been mutually cooperative between the Aurora Police Department, Division of Parks and Recreation and the Fox Valley Park District.  The collaboration between departments and agencies has contributed to increased safety and image to Phillips Park visitors.
 
DISCUSSION:
Both agencies met this winter to review the current agreement and discuss changes.  The Park District has agreed to not increase their cost for services for the first year of the agreement.  The last two years of the proposed contract the Park District has included a $3,000.00 increase bringing the cost for their services to $93,800.00 annually for 2015 and 2016.  This increase represents a 3.3% increase over the current cost but is less than a half percent increase per year since 2005.  During the current contract the Park District started providing coverage to all City Parks, not just Phillips.  This change created greater value to the agreement and the City.  The 2014 city budget provides the necessary funds for this item in account 101-4440-451.32-25 in 2014.  An additional $1,300.00 will need to be budgeted in years 2015 and 2016 to cover the cost of the contract increase.
 
IMPACT STATEMENT:
By not approving this agreement, City Parks will no longer have dedicated Park Security Services and the Aurora Police Department would become the primary responder for any incidences in the future.
 
RECOMMENDATIONS:
That the City Council adopts the Resolution Authorizing the Execution of an Intergovernmental Agreement between the City of Aurora and the Fox Valley Park District involving Police Services at Phillips Park and all other City Parks.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
 
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
 
WHEREAS, the City has maintained an intergovernmental agreement with the Fox Valley Park District concerning Police Services at Phillips Park since 2002; and
 
WHEREAS, the Park District agrees to provide police protection services at the City's Phillips Park and other City Park Properties with Park District police officers beginning March 1, 2014 through and including February 28, 2017; and
 
WHEREAS, the City shall pay the Park District for the first year of this agreement the sum of $90,800.00, and for the second and third years of this agreement, $93,800.00 for said services with one-half of said sum due on June 15th and one-half on October 1st of each calendar year of the agreement, the agreement may be cancelled by either party with a 60 day written notice; and
 
WHEREAS, the 2014 City Budget provides $92,500.00 for this item in account 101-4440-451.32-25 (General Fund), an additional $1,300.00 will need to be budgeted in years 2015 and 2016 and anticipates budget approval for 2015, 2016 and 2017.
 
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: Authorizes the execution of the attached Intergovernmental Agreement with the Fox Valley Park District for police services at Phillips Park and other City of Aurora Park Properties.
