SUBJECT:

An Ordinance Providing for the Execution of an Easement Agreement between the City of Aurora and the NICOR Gas Company, for the property located at 421 South River Street (City of Aurora / Chicago Title Land Trust - 19-0547 - AU28/2-19.096-DED/E - SB - Ward 4)  

 

PURPOSE:

The City of Aurora is requesting approval of an Easement Agreement between the City of Aurora and the NICOR Gas Company for an easement on the property located at 421 South River Street, to allow for utility maintenance on this property.  

 

BACKGROUND:

The subject property is owned by the Chicago Title Land Trust Company, and is located at the northwest corner of South River Street and Prairie Street.  The property is approximately .84 acres in size.  It is an industrial site.

 

The proposed easement agreement would allow for an approximately six (6) foot wide easement in the southeast corner of this property to contain a traffic signal controller cabinet, hand holes, and future sidewalk extension. 

 

DISCUSSION:

Staff has reviewed the Easement Agreement petition and have determined that it meets the applicable codes and ordinances. 

 

IMPACT STATEMENT :

The Zoning Division would anticipate that this project will increase the City's overall tax base and viability by facilitating investment and development, which will offset any incidental Department or Staffing impacts, enhancing the city's infrastructure and improving services to its residents.  

 

RECOMMENDATIONS:

Staff recommends APPROVAL of the Ordinance Providing for the Execution of an Easement Agreement for an Easement between the City of Aurora and the NICOR Gas Company, for the property located at 421 South River Street.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, Chicago Title Land Trust is the owner of 421 South River Street and has requested the City of Aurora to grant an easement agreement for the property located at 421 S River St; and

 

WHEREAS, the City of Aurora is requesting the owner enter into the Easement Agreement attached hereto as Exhibit “A” with respect to the City of Aurora granting said easement, which the owner has agreed to do.

 

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Aurora, Illinois, that the City Council of the City of Aurora, Illinois, hereby approves the Easement Agreement attached hereto as Exhibit “A” with Chicago Title Land Trust, providing for an easement agreement with the Chicago Title Land Trust Company for the property located at 421 South River Street.
