SUBJECT:

To Establish Fees and Fines related to the Chapter 6, "Alcoholic Liquor" of the City Code of Ordinances.

 

PURPOSE:

To create a separate resolution for Chapter 6 fees and fines related to "Alcoholic Liquor" to include, but not be limited to annual fees for liquor licenses and fines for violations of the portions of the code.

 

BACKGROUND:

The Special Ordinance Committee held its first meeting on November 14, 2018. The first ordinance revision being proposed was for the review of Chapter 6, "Alcoholic Liquor" and all fees and fines are being recommended for removal to be controlled by separate resolution. 

 

DISCUSSION:

The Code of Ordinances is being reviewed and one of the agreed upon changes, when available, is to remove fines and fees from the Code to create greater by allowing resolutions to control the increase and decrease in fines and fees when appropriate. All fines and fees that are currently in the Code of Ordinance will remain the same. This is a companion resolution to the changes being proposed to the Chapter 6 "Alcoholic Liquor" of the Code of Ordinances currently being reviewed by the Special Ordinance Committee for adoption. 

 

IMPACT STATEMENT:

This change will allow more flexibility for City Council to review and adjust fees and fines related to Chapter 6 "Alcoholic Liquor" in the Code of Ordinances.

 

RECOMMENDATIONS:

I request the proposed resolution be approved.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, it is necessary for the City of Aurora to determine by separate ordinance or resolution of the City Council certain fees and fines to be charged by the city.

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows:

Section One: That all Resolutions or part of Resolutions in conflict herewith are hereby repealed insofar as any conflict exists.

 

Section Two: That the Alcoholic Liquor Fines and Fees related to Chapter 6 of the City are set according to Exhibit A.
