SUBJECT:

A Resolution to extend the hours for the sale and consumption of liquor on Thursday, May 5, 2016 - Cinco de Mayo.

 

 

PURPOSE:

Certain establishments currently licensed to sell/serve liquor have requested an extended hour of sale and consumption of liquor for Thursday, May 5, 2016 (Cinco de Mayo).

 

BACKGROUND:

If approved, this would mark the third year the City of Aurora allowed extended hours for license classifications A, B, E and F on Cinco de Mayo. Similar to New Year's Eve, St. Patrick's Day and the day before Thanksgiving, Cinco de Mayo is a popular day for celebrations. Some licensees will celebrate with live acts, and would like to be afforded extra time. Last year, the City experienced no problems with this extension.

 

DISCUSSION:

This resolution, if approved, would not affect the current wording within the Liquor Ordinance, nor would it cause a permanent change in the Ordinance, as it is for the approval of extended hours on a single occasion.

 

As required in the past, any licensees granted permission to extend their hours on the abovementioned day would be required to meet additional conditions as stated in the proposed resolution below.

 

If approved, the office of the City Clerk would provide the Police Department with a list of all establishments that have applied for and have been granted permission to extend their hours by one (1) hour, resembling the manner in which we handle the extended hours for New Year's Eve.

 

IMPACT STATEMENT:

This resolution, if approved, would enhance business opportunities for establishments in connection with the upcoming observance of Cinco de Mayo.

 

RECOMMENDATIONS:

I request that this resolution be forwarded to the April 19, 2016 Committee of the Whole meeting to seek a recommendation for approval by City Council on April 26, 2016.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, it is the intention of the Council to hereby allow for the sale and consumption of alcoholic liquor by those approved establishments holding a Class A, B, E, or F license one hour later on Thursday, May 5, 2016 (Cinco de Mayo) (on Friday, May 6, 2016), provided that:

 

1. Live acts, which include vocal soloists or groups, instrumental soloists or groups (excluding DJ’s), have been hired as entertainment for May 5, 2016 (Cinco de Mayo); and

 

2. Menus must be in effect and food must be served and prepared on the premises, as specified in the City’s Liquor Ordinance, for the entire time of operation; and

 

3. Qualified establishments must apply and be approved by the Local Liquor Control Commissioner for the extended hour of operation; and

 

4. Said extension will be granted for the consumption on the premises only, with the hour of sale of packaged liquor not being affected by this resolution; and

 

5. Permission must be requested from the Local Liquor Control Commissioner not later than Friday, April 22, 2016; and

 

6. The Local Liquor Control Commission may deny such request from any establishment that has had its liquor license suspended within the past year or for any establishment that owes the City money or is in violation of any City codes; and

 

7. The passage of this resolution would not change the hours as set forth in the City’s Liquor Ordinance henceforth; and

 

WHEREAS, the fee for said extended hour shall be $50.00.

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that, on the evening of Thursday, May 5, 2016 (Cinco de Mayo), and upon approval by the Local Liquor Control Commissioner, the holders of a Class A Liquor License may be allowed to sell and serve alcoholic liquor until 12:00 midnight, and the holders of a Class B, E, or F Liquor License may be allowed to sell and serve alcoholic liquor until 2:00 a.m. (on Friday, May 6, 2016), provided that all of the above-referenced provisions are met.
