SUBJECT:

An Ordinance Changing the Name of Molitor Road to Diehl Road located between Felten Road and County Line Road (City of Aurora - 23-1005 / AU12/2-23.490-ST - TV - Ward 1)  

 

PURPOSE:

The City of Aurora is requesting a street name change from Molitor Road to Diehl Road located between Felten Road and County Line Road.  

 

BACKGROUND:

Kane County reached out to the City's Zoning and Planning Division regarding a street name discrepancy between the City and the County's records.  After research the discrepancy, there is not any records that show that the City formally changed the name of the street from Molitor Road to Deihl Road.  Therefore, this Ordinance is formally changing the street name from Molitor Road to Diehl Road from Felten Road to County Line Road. 

 

DISCUSSION:

Staff has reviewed the Street Name Change petition and have determined that it meets the applicable codes and ordinances. 

 

IMPACT STATEMENT :

This street name change will allow several properties to keep their existing address being off Diehl Road.  

 

RECOMMENDATIONS:

Staff recommends APPROVAL of the Ordinance Changing the Name of Molitor Road to Diehl Road located between Felten Road and County Line Road.

An Ordinance Changing the Name of Molitor Road to Diehl Road located between Felten Road and County Line Road

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, the City of Aurora desires, pursuant to Section 42-3 and 42-20 of Article I of Chapter 42 of the Code of Ordinance, City of Aurora, to change the name of a former portion of Molitor Road to Diehl Road as hereinafter set forth; and

 

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Aurora, Illinois, as follows:

 

Section One: That the City Council of the City of Aurora, Illinois finds as fact all of the preamble recitals of this Ordinance.

 

Section Two: That this Ordinance shall be in full force and effect, and shall be controlling, upon its passage and approval.

 

Section Three: That all Ordinances or part of Ordinances in conflict herewith are hereby repealed insofar as any conflict exists. 

 

Section Four: That any section, phrase or paragraph of this Ordinance that is construed to be invalid, void or unconstitutional shall not affect the remaining sections, phrases or paragraphs of this Ordinance which shall remain in full force and effect.

 

Section Five: That the name of former Molitor Road be and is hereby changed to Diehl Road between Felten Road and County Line Road, located within Section 12 of Aurora Township, Kane County Illinois, all as shown on the plat attached hereto as Exhibit “A”, and made a part hereof.

 

Section Six: That the City Clerk of the City of Aurora, Illinois, is hereby directed to forward a copy of this Ordinance after its passage and signing to the Director of Public Works so that the street sign may be changed, the Aurora Police Department / Communication - 911, and the Fire Marshall so that the name change may be noted on the “emergency response maps” and to the Zoning and Planning Director so that the name change may be noted on the Official Zoning Maps of the City of Aurora, and record this Ordinance at the Kane County Recorder’s office.
