Ordinance Authorizing the Sale of the Easterly five (5) feet of City Real Estate

(LOT 31) (except the North forty (40) feet thereof) Located at 333 West Park

Avenue, Aurora, Illinois Permanent Index No.:  Part of 15-22-102-032

 

 

PURPOSE:

Attached is an Ordinance Authorizing the Sale of the Easterly five (5) feet of City Real Estate (Lot 31) (except the North forty (40) feet thereof) commonly known as 333 West Park Avenue, with PIN# 15-22-102-032 to Philip Howard and Erin M. Howard, who own the adjacent property at 329 West Park Avenue.  Under the terms of the proposed sale, the Howards will pay the City One Dollar ($1.00) and consolidate the land with their current parcel.  This sale only includes the Easterly five (5) feet of the said property at PIN #15-22-102-032.  The City will be transferring the remaining Easterly 45.42 feet of (Lot 31) following the passage of this ordinance to Daniel C. Fitzpatrick, Sr. to be consolidated with 337 West Park Avenue, Aurora,

 

BACKGROUND:

In November, 2014 the City of Aurora purchased the property at 333 West Park Avenue, Aurora, Illinois with density reduction funds.  The structures on the property have since been raised and it is vacant.  The property is currently exempt from real estate taxes.    The lot is to be split and given to the adjoining land owner (the Howards) as legally described below:

 

THE EASTERLY FIVE (5) FEET OF LOT 31 (EXCEPT THE NORTH FORTY (40) FEET THEREOF) IN BLOCK 2 OF J.R. AND J.C. HANNA’S ADDITION TO AURORA, IN THE CITY OF AURORA, KANE COUNTY, ILLINOIS.

 

DISCUSSION:

The City has made this type of arrangement before with adjacent owners in order to dispose of vacant City-owned lots.

 

IMPACT STATEMENT:

Property will be back on the tax rolls.  City will no longer have to maintain the parcel.

 

RECOMMENDATIONS:

Place on Finance Committee Calendar (7/12/16 Agenda) for approval to City Council.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, the City of Aurora is interested in selling and Philip Howard and Erin M. Howard are interested in purchasing the real estate known as the Easterly five (5) feet of Lot 31 (except the North forty (40) feet thereof) in Block 2 of J.R. and J.C. Hanna’s Addition to Aurora, in the City of Aurora, Illinois with PIN Number 15-22-102-032 (“Property”) in  accordance with the terms and restrictive covenant set forth in the attached Agreement.)

 

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Aurora, Illinois, as follows: that the attached Agreement for the sale of the Easterly five (5) feet of Lot 31 (except the North forty (40) feet thereof) in Block 2 of J.R. and J.C. Hanna’s Addition to Aurora, in the City of Aurora, Illinois for the sum of $1.00 is hereby approved.  Additionally, Chuck Nelson is hereby authorized to act on the City’s behalf to complete the sale of this property.
