SUBJECT:

An Ordinance Amending Chapter 6 of the City of Aurora Code of Ordinances Entitled "Alcoholic Liquor".

 

PURPOSE:

The purpose of this memo is to add a new liquor license class to the Aurora Code of Ordinances to allow for the sale and service of beer and wine at full service salons and spas.   

 

BACKGROUND:

The current liquor code was adopted in 1986, with amendments made in 2010, 2011, 2015, 2016, 2017, and 2018.

 

DISCUSSION:

Currently, the code does not allow for sale or service of beer and wine on the premises of salons or spas. Recently, there has been an increased interest by local business to allow for such service to enhance the experience at these businesses. Adding an additional type of liquor license will increase further economic development within the City.

 

It is recommended that limits be placed regarding the number and frequency of beverages to be offered to patrons at establishments that attain such a liquor license.

 

The proposed changes to the Ordinance are in Sec. 6-8 Classification of Licenses in Attachment A, page 49, new Class T. The class T will be reassigned when the classifications in Chapter 6 are revised. This is a request coming from the business community.

 

RECOMMENDATION:

It is recommended the proposed changes to Chapter 6 of the City of Aurora Code of Ordinances entitled “Alcoholic Liquor” be forwarded to the Committee of the Whole.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, in furtherance of its home rule powers, it is necessary and desirable for the City of Aurora to amend its ordinances regarding Alcoholic Liquor. 

 

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Aurora, Illinois, as follows:

 

Section One:                      That Chapter 6 of the City of Aurora Code of Ordinances shall be and hereby is amended as set forth in Exhibit A:

                     

Section Two:                     That this ordinance shall be in full force and effect, and shall be controlling, upon its passage and approval.

 

Section Three:  That all ordinances or parts of ordinances thereof in conflict herewith are hereby repealed to the extent of any such conflict.

 

Section Four:  That any section or provision of this ordinance that is construed to be invalid or void shall not affect the remaining sections or provisions which shall remain in full force and effect thereafter.
