SUBJECT:

A Resolution Approving a Final Plan located on both sides of S. Eola Road, just north of Del Webb Boulevard for a pedestrian bridge (Pulte Home Group - 21-1024 / WH18/1-21.348-Fpn - TV- Ward 9)  

 

PURPOSE:

The Petitioner, Pulte Home Group, is requesting approval of a Final Plan for the construction of a pedestrian bridge over Eola Road, just north for Del Webb Boulevard.  

 

BACKGROUND:

The Subject Property is located on both sides of Eola Road and is part of the Lincoln Prairie Planned Development District.  The property on the east side of Eola Road is Lot 170 of Lincoln Crossing Subdivision and the property on the west side of Eola Road is currently a vacant commercial parcel. 

 

The Petitioner is requesting approval of a Final Plan for the construction of a 12' wide pedestrian bridge over Eola Road which would then be conveyed to the City. This bridge will Connect Lincoln Crossing and Lincoln Prairie by Del Webb Subdivisions to the future commercial parcel and to Wolf's Crossing Elementary School and Bednarik Junior High School.  As part of the pedestrian bridge, the Petitioner will be extending a 12' wide multi-use path on the west side of Eola Road to the school district's property and extending a 12' wide multi-use path on the east side of Eola Road to the Stonecrop Drive. The construction of the bridge will satisfy the Petitioner's Park Land Cash obligation for the Lincoln Prairie by Del Webb Subdivision.  The approved Annexation Agreement also includes provision to allow golf carts on the pedestrian bridge and the paths so that the residents of the age-restricted community can utilize the commercial without the need to drive their vehicles to shop.

 

The Final Plan proposal also includes a Landscape Plan consisting of landscaping around the bridge, path, and along Eola Road.

 

The bridge consists of a metal material with a cable railing.  The abutments, retaining walls and fence columns will have a stone veneer finish. The Petitioner will be working with the City on the final engineering design which includes bridge details, finishes, materials, decking, protection and abutment.

 

As part of the proposal, the Petitioner will be dedicating an easement and right-of-way along Eola Road for the abutment and maintenance of the pedestrian bridge. 

 

DISCUSSION:

Staff has reviewed the Final Plan petition and have sent comments back to the petitioner on those submittals.  The petitioner has made the requested revisions to these documents and they now meet the applicable codes and ordinances. 

 

POLICIES AND GUIDELINES:

The Staff’s Evaluation and Recommendation are based on the following Physical Development Policies:

 

13.0                      To plan and provide for the growth of the City through the coordination of land use patterns and functions with an integrated, efficient, accessible and energy-conserving circulation system.

13.01(6) To encourage the development of public transportation, bicycle and sidewalk systems that would link residential area or place of work, shopping and recreation.

63.01(1) To promote an integrated pedestrian circulation system in the City.  

 

RECOMMENDATIONS:

Staff recommends CONDITIONAL APPROVAL of the Resolution Approving a Final Plan located on both sides of S. Eola Road, just north of Del Webb Boulevard for a pedestrian bridge with the following conditions:

 

1. That the Final Plan approval is contingent upon Final Engineering approval.

 

2. That the Final Plan approval is contingent and subject to the approval of a License and Maintenance Agreement for the long-term maintenance of the pedestrian bridge and path.

 

3. That the Petitioner submit an executed Plat of Easement and Plat of Dedication for Eola Road to the City's Engineering Department prior to Final Engineering approval.

 

4. That the Petitioner work with the City to provide city signage on the bridge, if so desired, prior to Final Engineering approval.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, by petition dated December 1, 2021, Pulte Home Group filed with the City of Aurora a petition requesting approval of a Final Plan for property located on both sides of S. Eola Road, just north of Del Webb Boulevard for a pedestrian bridge and related required document as attached hereto as Exhibit "A-1" through "A-3"; and

 

WHEREAS, on January 26, 2022, the Building, Zoning and Economic Development Committee of the Aurora City Council reviewed said Final Plan and the before mentioned recommendations and recommended CONDITIONAL APPROVAL of said petition; and

 

WHEREAS, the decision of the Building, Zoning and Economic Development Committee with respect to a Final Plan is subject to appeal to the City Council in the manner set forth in the City of Aurora Subdivision Control Ordinance; and

 

WHEREAS, no person authorized under Chapter 43 of the Code of Ordinances, City of Aurora, being the Subdivision Control Ordinance, to appeal such decision having done so in the manner set forth in the Ordinance, the Decision of the Building, Zoning and Economic Development Committee constitutes final action on the proposed final plan; and 

 

NOW, THEREFORE, BE IT ORDAINED by the Building, Zoning and Economic Development Committee of the City of Aurora, Illinois, finds as facts all of the preamble recitals of this Resolution and hereby grants CONDITIONAL APPROVAL of said Final Plan with the following conditions:

 

1. That the Final Plan approval is contingent upon Final Engineering approval.

 

2. That the Final Plan approval is contingent and subject to the approval of a License and Maintenance Agreement for the long-term maintenance of the pedestrian bridge.

 

3. That the Petitioner submit an executed Plat of Easement and Plat of Dedication for Eola Road to the City's Engineering Department prior to Final Engineering approval.

 

4. That the Petitioner work with the City to provide city signage on the bridge, if so desired, prior to Final Engineering approval.

 

BE IT FURTHER RESOLVED that the Building, Zoning and Economic Development Committee of the City of Aurora hereby adopts the Final Plan and related required documents, as attached hereto as Exhibit "A-1" Final Plan, Exhibit “A-2” Landscape Plan, and Exhibit “A-3” Building and Signage Elevations, along with any easement dedications deemed necessary by the Aurora City Engineer.
