Resolution authorizing the execution of an Intergovernmental Agreement (IGA) between the City of Aurora and the Fox Metro Water Reclamation District (FMWRD) for work related to the CSO Control Policies, January 27, 2014 BGI meeting
PURPOSE:
The IGA will provide the means for the City and FMWRD to cooperate in meeting certain requirements of both organizations National Pollutant Discharge System (NPDES) permits.
BACKGROUND:
The 1994 USEPA CSO Control Policy requires that the City and FMWRD monitor and document the occurrences of overflows at all CSO outfalls within the City. The City owns 14 CSO outfalls. The FMWRD owns one CSO outfall within Aurora. The outfalls are permitted through the National Pollutant Discharge Elimination System (NPDES) permit program.
The CSO monitoring consists of maintaining and downloading information from flow monitors that are installed within the overflow structures for each CSO. Information from each flow monitor is down loaded and processed on a monthly basis. The monthly reports are then sent to the IEPA per their requirements. Aurora and FMWRD have been sharing the cost of this work since 1996.
DISCUSSION:
Funding for this work is provided in the 2014 budget within the Water and Sewer Fund in account no. 510-4063-511-73-13.
IMPACT STATEMENT:
Adopting this IGA will result in a reduction in expenses for the City of Aurora.

I respectfully request that this item be forwarded to the Building, Grounds, and Infrastructure Committee for their consideration.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, the Illinois Environmental Protection Agency requires that the discharge from all Combined Sewer Overflow (CSO) outfalls within the City of Aurora be monitored on a continuous basis; and
WHEREAS, the City of Aurora and Fox Metro Water Reclamation District have previously had an Agreement for operation and maintenance of the Combined Sewer Overflow outfalls (CSO) located throughout the City of Aurora, and have shared the costs thereof; and
WHEREAS, the parties have elected to renew the Agreement regarding the monitoring of the CSO Facilities and the sharing of the costs thereof which Agreement is attached hereto as Exhibit "A"; and
WHEREAS, said Agreement shall be for a period of five (5) years; and
WHEREAS, the 2014 Budget provides for this item in Account No. 510-4063-511.73-13 (Water and Sewer Fund).
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: the Mayor and City Clerk are hereby authorized to enter into an Agreement with the Fox Metro Water Reclamation District for the work related to the Combined Sewer Overflow Facilities control policies.
