A resolution authorizing the Director of Purchasing to enter into an agreement with WBK Engineering, LLC to perform on-site construction engineering services for the East Galena Boulevard and East Downer Place Sewer Separation Project, Water Street to State Street, in the amount of $480,381.57, pending approval of a loan from the Illinois Environmental Protection Agency (IEPA) Water Pollution Control Loan Program.
PURPOSE:
To enter into an agreement with WBK Engineering, LLC for the above referenced project.
BACKGROUND:
As part of the Clean Water Act, the Environmental Protection Agency created the National Pollutant Discharge Elimination System which resulted in several permits for the City of Aurora. As part of one of these permits, the City was required to create a Long Term Control Plan (LTCP) to reduce pollutants entering the Fox River and Indian Creek from the City's combined sewer system. This project is a required milestone of the LTCP created by the City to satisfy the permit.
DISCUSSION:
WBK Engineering, LLC proposes to provide on-site construction engineering services in an amount not to exceed $480,381.57. This project will begin in June of 2016 and is estimated to be completed in the fall of 2017. The 2016 budget includes funds in the following accounts for this work:
510-4058-511-73-02 - $92,500.00
281-1856-512-73-09 - $367,000.00
340-4460-431-73-80 - $16,381.57
It is anticipated that at various times throughout the project there will be a minimum of two representatives from WBK on-site to provide inspection on the work, in addition to City Staff.
In the event that the IEPA does not execute the loan agreement with the City for the sewer separation project, this contract would not be executed.
IMPACT STATEMENT:
During construction, there will be various roadway and lane closures, delays are to be expected. It is not anticipated that there will be any additional impact on other departments within the City.
RECOMMENDATIONS:
I recommend that this resolution be adopted.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, it is necessary to meet the requirements of the City's Long Term Control Plan, including the separation of the combined sewer system; and
WHEREAS, the construction of this sewer separation project is tentatively scheduled for construction in June of 2016 and will continue through the Fall of 2017; and
WHEREAS, it is necessary and desirable to provide on-site construction engineering for this project; and
WHEREAS, due to the volume of work and on-site staff required for this project, the City will require the services of an outside consultant to supplement City Staff to provide adequate on-site inspection; and
WHEREAS, there is a need for a construction engineering agreement with WBK Engineering, LLC to provide on-site construction engineering services for the East Galena Boulevard and East Downer Place Sewer Separation Project, Water Street to State Street, in an amount not to exceed $480,381.57; and
WHEREAS, funds have been provided for this work in the 2016 budget in the following accounts:

340-4460-431-73-81 - $16,381.57
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: the Agreement with WBK Engineering, LLC to perform on-site construction engineering services for the East Galena Boulevard and East Downer Place Sewer Separation Project, Water Street to State Street, is hereby authorized in the amount of $480,381.57, pending approval of a loan from the Illinois Environmental Protection Agency (IEPA) Water Pollution Control Loan Program).
