SUBJECT:

A Resolution approving a Law Enforcement Mutual Aid Agreement between the City of Aurora and the City of Naperville. 

 

PURPOSE:

The Aurora Police Department, through the City of Aurora, Illinois, (hereinafter, "Aurora") is requesting the approval of the attached agreement between Aurora and the Naperville Police Department, through the City of Naperville, Illinois, (hereinafter, "Naperville").  This agreement would provide each city with mutual aid in the event additional aid is needed.

 

BACKGROUND:

This agreement came to fruition in an effort to formalize oral agreements and create plans in case of large scale emergencies with our neighboring police departments.

 

DISCUSSION:

In the event that Aurora or Naperville needs assistance to handle a situation that requires additional police assistance, each department will be able to contact the other department for help. This agreement outlines the responsibilities and the liabilities each party has.

 

IMPACT STATEMENT:

The agreement outlines the responsibilities of each party during an incident.

 

RECOMMENDATIONS:

The Aurora Police Department requests the approval of this agreement and for the Mayor, or his designee, to sign the agreement upon approval of City Council.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, the Aurora Police Department, through the City of Aurora, a municipal corporation, and the Naperville Police Department, through the City of Naperville, a municipal corporation, wish to enter into an agreement to provide mutual aid when necessary; and

 

WHEREAS, the Aurora Police Department and the Naperville Police Department have each determined it to be in their best interests to form a law enforcement mutual aid task force to cooperate in the investigation of criminal activity; enforcement of the laws of this State; and to protect health, life and property from riot, disaster, and unlawful assembly characterized by force and violence or threatened violence by groups; and

 

WHEREAS, Illinois Compiled Statutes, Chapter 5, Section 220/1 et seq., known as the "Intergovernmental Cooperation Act," authorizes units of local government in Illinois to exercise jointly with any other public agency within the state, including other units of local government, any power, privilege, or authority which may be exercised by a unit of local government individually and to enter into contracts for the performance of governmental services, activities and undertakings; and

 

WHEREAS, Aurora and Naperville are public agencies within the meaning of the Intergovernmental Cooperation Act.

 

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that the attached agreement between the City of Aurora, Illinois and the City of Naperville, Illinois, is fully adopted as set forth in the attached document and the Mayor or his designee shall be and hereby is directed to execute said agreement on behalf of the City.
